|a يتناول هذا البحث التعريف بالشخص الحكمي وأنواعه في الفقه الإسلامي، ومدي تحقق مسئوليته المدنية والجنائية عن أخطائه وتجاوزاته، كما يوصل البحث هذه الشخصية ووجودها في الفقه الإسلامي مع بيان السند الشرعي على وجودها ومساءلتها، لذا وجب أن يسأل هذا الشخص يرتكبه من أخطاء أو يقصر في أداء واجباته والتزاماته، وكذلك مساءلته عما يقترفه اتباعه وضمان أخطاء ممثليه أو غير ذلك، فالمسئولية لا تأتي على نسق واحد لكنها تتنوع بحسب نوع التعدي: مسئولية مدنية، ومسئولية جنائية. فهو يصلح لأن يكون محلاً للتقاضي، فيكون مدعياً ليحصل على حقوقه، ويكون مدعي عليه يقاضيه الآخرون، ويثبت له حق الدفاع عن نفسه ومصالحه بكافة وسائل الإثبات.
