المستخلص: إن استفحال ظاهرة الطلاق المنعقد عبر وسائل الاتصال الحديثة في المجتمعات الإسلامية عموماً، وفي المملكة العربية السعودية تحديداً أصبحت تطرح العديد من التساؤلات حول صحة وقوعه، ومدى الاستعانة بهذه الوسائل لإثبات الطلاق أمام المحاكم السعودية.
في ظل الانقسام السائد بين فقهاء المجتمعات العربية والإسلامية حول الاعتراف بمسألة اللجوء إلي هذه الوسائل في مجال الأحوال الشخصية، تمكنت هذه الظاهرة من فرض نفسها من خلال انتشارها الرهيب في هذه المجتمعات مما جعل الكثيرين يعتبرونها كباقي الوسائل المعبرة عن الإرادة، والتي يعتد بأثارها القانونية المترتبة عنها.
لم يؤد التطور التكنولوجي الحديث في مجالات الاتصالات والإنترنت إلى توفير الضمانات الكافية للقضاء على بعض الأساليب التي يلجأ إليها بعض الأفراد، والتي برهنت في الوقت نفسه قابلية وسائل الاتصال الحديثة للتعرض إلى القرصنة والغش والاحتيال، الأمر الذي جعل بعض المجتمعات تستبعدها بشكل نهائي من مجال الأحوال الشخصية نظراً لحساسية مواضيعها وقداسة روابطها التي أكدتها الشريعة الإسلامية في أكثر من موضع.
بين مؤيد ومعارض لهذه الظاهرة، وأمام الفراغ القانوني السائد في الأنظمة السعودية أصبح من الضروري على المنظم السعودي الالتفات لهذه الظاهرة والاهتمام بها من خلال وضع نصوص وأحكام توضح للأفراد شروط وضوابط اللجوء إلي وسائل الاتصال الحديثة لإيقاع الطلاق، وكيفية الاحتجاج بها أمام القضاء لتحديد حجيتها مقارنة مع وسائل الإثبات التقليدية التي تضمنها نظام المرافعات الشرعية السعودي.

The growing phenomenon of divorce being conducted over modern means of communication in Islamic societies in general and in the Kingdom of Saudi Arabia specifically, has led to the raising of many questions concerning the validity of its occurrence and concerning the extent of reliance upon these means to prove the divorce before Saudi courts.
Due to the prevailing division among the scholars of the Arab and Islamic societies in respect to acknowledging the issue of resorting to these means within the area of personal affairs, this phenomenon has been able to impose itself through its frightening spread within these societies and has therefore made many consider it to be like the rest of the means which express one’s will and concerning which its legal effects count.
Modern technological development in the areas of communications and the internet has not led to the provision of sufficient guarantees to eliminate some of the approaches resorted to by some individuals, whilst at the same time, the potential of the modern means of communication being exposed to piracy, deception and fraud, has been demonstrated. This matter has led to some of the societies to exclude it permanently from the areas related to personal affairs, due to the sensitivity of its subject areas and the sanctity of the ties which the Islamic Sharee’ah (law) has affirmed in numerous contexts.
Between the supporters and the opponents of this phenomenon and before the legal vacuum prevailing in the Saudi (legal) systems, it has become necessary for the Saudi regulator to turn its attention to this phenomenon and to be concerned with it by presenting the texts and rulings which clarify to the individuals the conditions and controls related to resorting to modern means of communication to effect divorce. That is in addition to making clear the manner of invoking them before the judiciary to determine their legal validity when compared to the traditional means, which the Saudi legal proceedings encapsulate.
