|a هناك بعض الدراسات العلمية التي تشير إلى وجود مخاطر على صحة الإنسان من الموجات الكهرومغناطيسية المنبعثة من هوائيات شبكة الهاتف المحمول خاصة لمن يقيمون بالمساكن القريبة من هذه الأبراج.\nإلا أنه من ناحية أخرى فهناك بعض الجهات الدولية والمحلية التي ترى بأن هذه المخاطر غير مؤكدة، وأن الأمر يحتاج إلى مزيد من الدراسات والأبحاث لتأكيد هذه المخاطر.\nولكن إلى أن تؤكد الدراسات هذه المخاطر، يتزايد القلق الشديد من قبل الأفراد القاطنين بجوار هذه الأبراج خوفاً على صحتهم وصحة أولادهم، الأمر الذي أدى إلى تدخل المشرع لتنظيم وضع هذه الهوائيات بطريقة تقلل من الأضرار الناجمة عنها.\nولكن تظل المشكلة في أن احترام شركة الاتصالات للقواعد المقررة لتركيب هذه الهوائيات لا ينفي إمكانية حدوث ضرر صحي للأفراد القاطنين بجوار هذه الهوائيات.\nومن ناحية أخرى فإن هناك مشكلة في إثبات وجود الضرر من قبل من يقيم بجوار برج التقوية في حال رفع دعوى على شركة الاتصالات في ضوء عدم وجود يقين علمي بوجود هذا الضرر.\nفإقامة المسؤولية المدنية لشركة الاتصالات عن الأضرار الصحية التي قد تصيب أي شخص يقيم بجوار هوائيات الشبكة أمر محل نقاش في ضوء عدم يقينية الأضرار الناجمة عن أبراج التقوية.\nسنقوم في هذه الدراسة بتطبيق القواعد العامة للمسؤولية المدنية لإقامة مسؤولية شركة الاتصالات عن المخاطر التي تحدثها هوائيات شبكة الهاتف المحمول، وذلك في ضوء عدم اليقين العلمي للضرر الذي تحدثه هذه الهوائيات.

|f There are some academic studies which indicate to the existence of human health risks from electromagnetic waves emitted from mobile phone company signal towers and especially for those living in the vicinity of these towers.\nHowever, from another angle, there are international and national bodies which view these risks to be unconfirmed and that the matter requires further studies and research in order to confirm these risks.\nHowever, until the studies confirm these risks, the great anxiety of those living in the vicinity of these towers increases, fearing for their health and the health of their children, a matter which led to the intervention of the legislature to regulate the placing of these antenna towers in a manner which diminishes the harms resulting from them.\nDespite that, the problem remains, in that the telecommunication companies respecting of the set regulations for the installation of these antennas does not negate the possibility of the occurrence of harm to the health of the individuals located in the vicinity of these signal stations. \nFrom another angle, there is a problem in respect to confirming the presence of harm befalling those residing in the vicinity of the signal boosting tower, related to the situation of raising a case against the telecommunications company, due to scientific uncertainty concerning the presence of such a harm. \nEstablishing the civil liability of the telecommunications company for health damage which could afflict a person residing in the vicinity of the network’s antennas, represents a point of discussion or debate due to the uncertainty linked to establishing the harms caused by the signal boosting towers. \nIn this study we will apply general principles of civil liability to establish the responsibility of telecommunications companies in relation to the risks which the mobile phone network antennas bring, and that is due to the scientific uncertainty related to the harm caused by these antennas.\nThis abstract translated by Dar AlMandumah Inc 2018.
