This research titled: (jurisprudential thought when the "Son of Mourning" Shafi'i (d. 344 AH)). Aim: detection aspects of the thought of Imam "Son of Mourning" Shafi'i (d. 344 AH), and his knowledge and diligence. It includes an introduction, boot, and three sections: Introduction: it has dealt with the aim of the research, and what it included. هذا بحث بعنوان: (الفكر الفقهي عند "ابن الحداد" الشافعي (ت 344 ه)). الهدف منه: الكشف عن جوانب من فكر الإمام "ابن الحداد" الشافعي (ت 344 ه)، وعلمه واجتهاده. وهو يشمل مقدمة، وتمهيد، وثلاثة مباحث: المقدمة: فقد تناولت فيها الهدف من البحث، وما اشتمل عليه. التمهيد: قمت فيه بعمل ترجمة موجزة عن " ابن الحداد" الشافعي (ت 344ه) المبحث الأول: بعنوان: (الفقه الافتراضي عند ابن الحداد)، ويتناول: الافتراض والتقدير لغة، والفقه الافتراضي اصطلاحاً، ونشأة الفقه الافتراضي، وأهمية الفقه الافتراضي، وأدلة المعارضين والمؤيدين للفقه الافتراضي، وشهرة ابن الحداد بافتراض المسائل الفقهية بين علماء المذهب الشافعي، وأساليب التعبير عن المسائل الافتراضية عند "ابن الحداد"، وأقسام مسائل الفقه الافتراضي عند" ابن الحداد". المبحث الثانى: بعنوان: (موقف ابن الحداد من أدلة الفقه.)، وتناول: موقف ابن الحداد من الاستدلال بالقرآن الكريم، وموقف ابن الحداد من الاستدلال بالحديث الشريف، وموقف ابن الحداد من الإجماع، وموقف ابن الحداد من القياس، وموقف "ابن الحداد" من الاجتهاد. المبحث الثالث: بعنوان :(منهج "ابن الحداد" فى الفتوى). ثم ذكرت أهم ما توصلت إليه من نتائج، يليها ثبت المصادر.
