المستخلص: لقد قام المجتمع الدولي بتبني عدة اتفاقيات أولت قضية تجنيد الأطفال أهمية كبيرة ولعل أهمها اتفاقية الأمم المتحدة لحقوق الطفل سنة 1989،والبروتوكول الاختياري الملحق بها بشأن اشتراك الأطفال في النزاعات المسلحة سنة 2000، واللذان وفرا حماية مهمة للأطفال من التجنيد في النزاعات المسلحة، فقد ناشدت المادة 38 من اتفاقية الأمم المتحدة لحقوق الطفل الدول الأطراف أن تضمن ألا يجند الأشخاص الذين لم تبلغ سنهم خمس عشرة سنة وأنه في حالة تجنيد من بلغوا الخامسة عشرة فعلى الدول الأطراف في الاتفاقية أن تعطي الأولوية لمن هم أكبر سنا،غير أن هذه المادة ناقضت في نفس الوقت ما جاء في نص المادة الأولى من الاتفاقية نفسها،حيث حددت هذه الاتفاقية سن الطفولة بثماني عشرة سنة،ومن ثم فإنه يسمح للدول الأطراف في الاتفاقية أن تقوم بتجنيد الأطفال فيما بين سني الخامسة عشرة والثامنة عشرة في قواتها المسلحة،علما بأن هؤلاء الأشخاص فيما بين العمرين السابقين يعدون أطفالا. أمام هذا القصور،تبنى المجتمع الدولي البروتوكول الاختياري بشأن اشتراك الأطفال في النزاعات المسلحة الذي نصت المادة الأولى منه على رفع الحد الأدنى لسن الاشتراك في الأعمال العدائية من 15 سنة إلى 18 سنة،إلا أن هذا البرتوكول لم يسلم من الانتقادات تعلقت أهمها بطبيعة الالتزام المفروض على الدول والذي يفتقد إلى صياغة الإلزام، إضافة إلى توفيره حماية خاصة فقط بالأطفال المشاركين بصفة مباشرة في القتال. رغم الانتقادات الموجهة لاتفاقية الأمم المتحدة لحقوق الطفل والبرتوكول الاختياري الملحق بها إلا أن هذا لا ينتقص من قيمتهما ودورهما في حماية الأطفال من التجنيد في النزاعات المسلحة وذلك في انتظار التبني الفعلي والصحيح لهما من قبل المجتمع الدولي وتجسيد أحكامهما على أرض الواقع.

Faced with this shortcoming, the international community adopted the Optional Protocol on the Involvement of Children in Armed Conflict, which provided the first article to raise the minimum age for participation in hostilities from 15 years to 18 years of business, but that the protocol was not spared from criticism concerned the most important of the nature of the obligation imposed on states that misses to the formulation cram in addition to provided special protection only to children directly involved in the fighting. Despite the criticism of the United Nations Convention on the Rights of the Child and the Optional Protocol thereto, but this does not detract from their value and their role in protecting children from recruitment in armed conflicts as they wait for the actual right of adoption for them by the international community and the embodiment of their provisions on the ground.
