تناولت هذه الدراسة الحقوق التي تتعلق بتركة المتوفى عندما تضيق عن الحقوق المتعلقة بها (تتزاحم)، وذلك ببيان هذه الحقوق، واختلافها في الرتبة، وكيفية تقديم بعضها على بعض عند التزاحم، وفق ضوابط دقيقة، بهدف بيان عناية الإسلام الفائقة بالحقوق المالية ومنهجه في تقديم بعض الحقوق على بعض والأسس المتبعة في ذلك، وفق نظام راق ومتطور، بما يسهم في إبراز واقعية الأحكام الشرعية، وعنايتها بكل ما يهم المسلم حياً وميتاً. وقد خلصت هذه الدراسة إلى أن تزاحم الحقوق المتعلقة بالتركة يقع بين الحقوق على اختلاف رتبها، كما يقع بين الحقوق في الرتبة الواحدة، عندما تضيق التركة عن الوفاء بالحقوق المتعلقة بها، وأن بعض هذه الحقوق يقدم على بعض أحياناً، كما في ديون الله تعالى، وديون العباد، بينما تقسم التركة أو ثلثها بالنسبة بين أصحاب الديون والوصايا عند التزاحم. كما وضعت الدراسة ضوابط تسهم في الترتيب عند التزاحم بين ديوان الله تعالى، وبينها وبين ديون العباد، والتزاحم بين ديون العباد، وبين الوصايا كذلك، علاوة على وضع ضوابط لكفالة خزينة الدولة الإسلامية لديون الميت عندما تقصر عنها التركة.
This study handles the rights related to the heritage of the deceased when it is confused with its related rights by showing these rights, and their different ranks , and how to submit one before the other in case of confusion according to accurate regulations aiming to show the greatest attention that Islam gives to the financial rights, and its approach in giving priority to some rights over others and the bases followed in this matter and according to elevated and developed system contributing to highlight the reality of the legal judgments and their focus on the rights of the Muslim, whether dead or alive. The findings of this study suggest that the confusion of rights related to the heritage lies among the rights at their different ranks and in the rights of the same rank when the heritage can not satisfy its related rights and that some of these rights have priority over others as in the book of Alla and according to system of people, while the heritage or its third is divided among the creditors and trustees in case of confusion . The study also put controls contributing to the arrangement when there is confusion between the Book of God Almighty , and between the system of the people and the confusion between the system of the people and the guardianships in addition to putting regulations to sponsor the Islamic state treasury for settling the debts of the deceased when the heritage fails to do that.
