لهذا، وضع قانون المنظمة العالمية للتجارة على مستواه، استثناءات عند تطبيق قواعد المنظمة واتفاقاتها متعددة الأطراف، تأخذ بعين الاعتبار مطلب الدول لتحقيق السلامة البيئية، وبدت هذه الفنية الحل الأمثل للتخفيف من عدد وحدّة النزاعات، وانعكاساتها.

Depuis des décennies, le débat a émergé sur la relation entre le commerce international et l'environnement, surtout après la création de l’OMC, il semblait que l’entrée en vigueur du droit de l’OMC menace terriblement l’écosystème, peut conduire aux différends à caractère environnemental qui laissent leurs mauvais effets sur la scène politique.
La difficulté est apparu sur la détermination du prioritaire a protéger ; la libéralisation du commerce international ou l’environnement.
Pour cela, le droit de l’OMC intègre dans leurs dispositions, des exceptions environnementales lors de l’application des règles de l’OMC, qui prendre en compte des payés à attendre la sécurité écologique, comme une solution idéal pour minimiser les conflits et leurs réflexions.

For decades, the discussion about the relationship of international trade with the environment arose, especially after the establishment of the World Trade Organization (WTO). That is as the operation of the WTO law appeared to threaten the environmental system. It could lead to special disputes with an environmental dimension that have adverse effects on the political scene. It has been difficult to identify the former to protect the freedom of international trade or to protect the environment, as long as interest in one alone could destroy the other.
For this reason, WTO law has established exceptions in respect to the application of WTO rules and multilateral agreements that take into account the requirement of States to achieve environmental integrity. This technique has been the best solution for mitigating the number and intensity of disputes and their ramifications.
