|f This research is based on an important idea related to the role of the purposes of Shariah (law) in the making of the fatwa, at a time when cries have been made to the need to return to this knowledge to reformulate a new jurisprudential system, taking into account the general interests and purposes of Islamic law to be followed in this approach an integrated scientific approach that combines the texts and the spirit of the Shariah (law).\nTalking about the role of the purposes of making fatwa does not make it necessary to say that the rules of Islamic fiqh (jurisprudence) are abolished. It is also not possible to talk about intentional rules that enrich those who seek to prey on the principles of deduction that have been adopted by the jurists since the first centuries. Therefore, it was important here to recall that many of those who write in this subject only want to break away from the Islamic rulings, leaning on the knowledge of the purposes, shaking down the parameters and trampling the necessary knowledge of religion. It is daring to religion and it does not have Abu Bakr. The work presented is not a step in the right way, but rather a bright light for every researcher to understand how to deal with this topic.\nThe problem of the research: The starting point of this research is to demonstrate the importance of the science of the purposes in building Islamic rulings, and to highlight the close relationship that exists between the principles of fiqh (jurisprudence) and the purposes of the Islamic Shariah (law). If this is the case how can it be used when making a fatwa and building such rulings? What are the ways in which ijtihad (extrapolation) should be done according to it, both in brief and in detail, and what is the effect of activating the knowledge of the purposes of sharia (law) in deriving the rulings and interpreting the texts?\nThis abstract translated by Dar AlMandumah Inc. 2018

|a يقوم هذا البحث على فكرةمهمّة تتعلّق بدور مقاصد الشّريعة في صناعة الفتوى، في زمن تعالت فيه الصّيحات إلى ضرورة الرّجوع إلى هذا العلم لإعادة صياغة منظومة فقهيّة جديدة، تراعى فيها المصالح والمقاصد العّامة للشّريعة الإسلاميّة، على أن يسلك في ذلك منهج علميّ متكامل يزاوج بين نصوص الشّريعة وروحها. \nإنّ الحديث عن دور المقاصد في صناعة الفتوى لا يلزم منه أبدا القول بإلغاء العمل بقواعد أصول الفقه الإسلامي، كما أنه ّمن غيرالممكن الحديث عنقواعد مقاصديّة تغني الباحثين عن الانشغال بأصول الاستنباط التي جرى عليها الفقهاء منذ القرون الأولى، ولذلك كان من المهم هنا أن نذكّر بأنّ العديد ممن يكتب في هذا الفنّ إنّما يريد الانسِلاخ من الأحكام الشرعيّة متّكئًا على علم المقاصد، يهشّ به الثّوابت ويدوس به ما عُلِم من الدّين بالضرورة، وهي جرأة على الدّين ولا أبا بكر لها، والعمل المقدّم لا يمثّل خطوة في الطريق الصحيح بقدر ما هو إشارات مضيئة لكلّ باحث حتى يدرك سبل التّعامل مع هذا الموضوع.\nإشكالية البحث: إنّمنطلق هذا البحث هو بيان أهميّة علم المقاصد في بناء الأحكامالشرعيّة، وإبراز العلاقة الوطيدة الموجودة بين أصول الفقه ومقاصد الشريعة الإسلامية الغرّاء،وإذا كان الأمر كذلك فما هي كيفية الاستفادة منها عند صناعة الفتوى وبناء تلك الأحكام؟ وما هي المسالك التي ينبغي الاجتهاد على وفقها؛ على الجملة وعلى التّفصيل، وما أثر تفعيل علم مقاصد الشريعة في استنباط الأحكام وتفسير النّصوص؟.

|d Cette recherche se base sur idée importante concernant le rôle de La science des objectifs de la religion (maqassid Chari’a) dans l’élaboration de la fatwa, en effet cette dernière est l’une des branches les plus importantes de l’enseignement traditionnel musulman, S’intéressant aux finalités des prescriptions islamiques, et donnant à la raison une place prépondérante à l’esprit et aux visées de la législation.\nSi La Fatwa consiste en une interprétation du texte traditionnel en vue de statuer sur un sujet ou émettre un ordre légal,il convient de dire que l’ijtihad moderne ne peut être efficace que s’il est pratiqué dans le respect des visées générales de la législation islamique, ainsi que les autres sources de la législation islamique (Coran, Sunna, consensus, qiyas) qui représentent les fondements du droit et de la jurisprudence (usûlalfiqh).\nProblématique du sujet : l’objet de cette recherche est de démontrer l'importance de la science dans l’élaboration de la fatwa, et de mettre en évidence la relation qui existe entre la science des objectifs de la religion et les fondements du droit et de la jurisprudence, si oui, quelle est la meilleur façon d’en bénéficier ? Et Quels sont alors les outils et les mécanismes qui devraient être développés pour une lecture saine du texte religieux.
