لقد شرع الله –عز وجل -الأحكام لأغراض وغايات؛ هي عبارة عن الحكم والمصالح. والنصوص الشرعية جاءت مراعية مصالح العباد في العاجل والآجل، آمرة بتحقيق المقصود منها. فهل النصوص الشرعية محكمة الفهم والاستنباط؟ وبالتالي تكون مقصورة العمل والتطبيق؟. أم هي غير ذلك؟ وبالتالي تسع الوقائع المستجدة، والنوازل الحادثة، والظروف المتغيرة؟. أجاب البحث عن هذه التساؤلات من خلال استنطاق بعض النصوص، واستخراج دقائق المعاني، والوقوف على الحكم والمصالح، واستظهار مقصود الشارع منها. كما سلط الضوء على فهم هذه النصوص من خلال المصلحة التي شرعت الأحكام لأجلها، وتفسيرها على أساس مقصود الشارع منها، وبيان التطبيقات المعاصرة لها بما يتواءم مع الأصول المبنية على المصلحة.
The role of society in understanding the text and contemporary applications All Praises be to Allah, and may peace and blessings be upon the Messenger of God. And to proceed; The law of Allah – the Most High – Is a provision for the purposes and objectives of judgments and interests. The religious texts take into account the interests of people for the immediate and long-term. It intends to achieve this in a medium. Does the Court understand the religious texts and the reasons for the deductions from them? And as a result are they limited by the applications and how it works. Or is it something that can be understood at all? Thus nine facts emerge, in regard to the calamities, incidents, and changing circumstances. To find answers to these questions extensive research has to be done, in regards to the texts, time, and extracted understanding, reasons for the judgments, interest of the individuals, and level of memorization of the religious rulings by the judge. It also sheds light on the understanding of these texts through the authority which initiated the rulings and their interpretations and understanding of the religious rulings. Also the statements of its contemporaries and their applications in line with rulings that have been deduced previously. I ask Allah the Almighty to reconcile that which He loves and which pleases Him. This work is made purely seeking the face of Allah The Most Generous.
