|a الحمد لله والصلاة والسلام على رسول الله وآلة وصحبه ومن والاه، أما بعد: إن الصناعات–ومنها الطبية-في تغير وتبدل وتطور مستمر، من هنا فعلى المفتي الذي يريد الوصول إلى الصواب في الأمور المبنية على الوقائع الطبية أن يراقب ويفهم ذلك الواقع قبل إصدار الفتوى، وإلا فإن ضرره قد يكون أكثر من نفعه، وحتى لو كان ما يفتي به منصوصاً في كتب الفقهاء الأقدمين. من هنا تلوح أهمية بيان وتوضيح أثر التطور الطبي على فتوي المفتي، فإن لهذا الأمر الأثر البارز في صناعة المفتي وفق الصناعة المطلوبة شرعاً والمحققة للأغراض الصحيحة من وجود المفتين. وقد ذكر الباحث ستة آثار هي: الأول: أثر التطور الطبي في تثبيت الفتاوي القديمة. الأثر الثاني: أثر التطور الطبي في تعليل الفتاوي. الأثر الثالث: أثر التطور الطبي في ترجيح الفتوي بأحد القولين القديمين. الأثر الرابع: أثر التطور الطبي في زيادة تفصيلات فقهية جديدة. الأثر الخامس: أثر التطور الطبي في إنشاء فتاوي جديدة لأحكام غير مسبوقة. الأثر الأخير وهو السادس: أثر التطور الطبي في تغيير الفتاوي القديمة وإعطائها حكماً جديداً. وذكرت تحت كل أثر من هذه الآثار نماذج مختلفة من فتاوي فضيلة العلامة الشيخ محمد الصالح العثيمين-رحمة الله تعالي-لمكانته العلمية المرموقة-رحمة الله تعالى-ولأنه أبرز المفتين في عصرنا. وأوصي الباحث: -بالعناية بالتطورات الطبية المعاصرة لما لها من أثر كبير في إعطاء الحكم الشرعي والفتوي الصحيحة. -وبعقد مؤتمرات طبية وورش عمل دورية تكون بمشاركة نخبة من ثقات الأطباء المعاصرين مع المختصين بالعلوم الشرعية والمفتين، لأهمية اطلاع المفتين على التطورات الطبية بشكل دوري وتصور الواقع الطبي على حقيقته، ولما يؤدى ذلك أيضاً من اطلاع المفتين على المسائل التي يحتاج الأطباء إلى معرفة أحكامها الفقهية. -وبضرورة إلمام المفتين بالمعلومات الأساسية التي تنبني عليها المسائل الطبية التي لها علاقة بالفتاوي خاصة النوازل منها، حتى يكون المفتي على قدر من العمق المطلوب، عند تصديه للفتوي في المسائل الطبية؛ لأن المعول عليه في إيجاد الحلول الشرعية المفتي لا الطبيب.
