المستخلص: الحمد لله رب العالمين، والصلاة والسلام على خاتم الأنبياء والمرسلين، وعلى آلة وصحبه أجمعين، وبعد. فهذا بحث بعنوان: "مفهوم الموافقة وموقف الأصوليين منه -دراسة أصولية مقارنة-"؛ للباحث: الدكتور/ عبد الوهاب بن عبد الله الرسيني؛ اعتمد الباحث فيه المنهج الاستقرائي التحليلي، لدراسة هذا الموضوع المتعلق بدلالات مصادر التشريع، وحرر في البحث موقع مفهوم الموافقة من دلالة اللفظ على الحكم من ناحية كونه تحت المفهوم أو دلالة الالتزام وأنه تحت المفهوم، وأيضاً بين المسميات الأخرى لمفهوم الموافقة ومن سمى بها ومن تلك الأسماء: فحوى الخطاب أو فحوى اللفظ، أو لحن الخطاب أو لحن القول، ومفهوم الخطاب، والتنبيه أو تنبيه الخطاب، ثم بين حجية مفهوم الموافقة وأدلة اعتباره والرد على من أنكره؛ وأن شرط مفهوم الموافقة هو معرفة معني الحكم في المنطوق، ومعرفة عدم نقصان منابته في المسكوت عن المنطوق؛ وأن مفهوم الموافقة ينقسم إلى مساوٍ وأولوي، وإلى قطعي وظني؛ وبين جواز التخصيص بمفهوم الموافقة، وأنه عام يقبل التخصيص؛ وأنه يجوز النسخ بمفهوم الموافقة، ويجوز نسخه دون المنطوق، ويجوز نسخ المنطوق دون مفهوم الموافقة، ويجوز نسخهما معاً؛ وبين أن المنطوق ودلاله الإشارة ودلالة التنبيه والإيماء ترجح على مفهوم الموافقة باتفاق، ويرجح الجمهور دون الحنفية دلالة الاقتضاء على مفهوم الموافقة وأما الحنفية فبالعكس، ويرجح مفهوم الموافقة على مفهوم المخالفة باتفاق عند من يقول بمفهوم المخالفة، وذكر عدداً من التطبيقات لمفهوم الموافقة على بعض الآيات والأحاديث، وبين خلالها خطأ بعض الأصوليين بإدخال تطبيقات من دلالة الإشارة في مفهوم الموافقة. والله الموفق، وصلى الله وسلم على نبينا محمد وعلى آلة وصحبه.
