|a الحمد ﷲ أولا وآخرا، والصلاة والسلام على خاتم الأنبياء والمرسلين، الذي بعثه الله تعالى للناس كافة بشيرا ونذيرا، وعلى آله وأصحابه أجمعين، ومن تبعهم بإحسان إلى يوم الدين. البحث يتكلم عن عالم من علماء المذهب الشافعي إلا وهو الإمام الصيدلاني هو محمد بن داوود بن محمد الداوودي، إلا أن كتب التراجم والطبقات لم تذكر يوما ولا مكانا لولادته، فقد ذكرت سنة وفاته فقط (ت 724 ه) أن هؤلاء الأعلام لم تجمع آراؤهم الفقهية في مؤلفات خاصة، ولم تضمها كتب مستقلة، بل بقيت متناثرة بين بطون كتب الفقه، فكان رغبة مني في تسهيل الاستفادة من علمهم، اتجهت إلى جمع آراؤه الفقهية في باب من أبواب الفقه وهو باب القضاء ويظهر من خلال نقل آرائه من قبل كبار فقهاء الشافعية في كتبهم مثل الإمام الجويني، والغزالي، والنووي، وغيرهم وافق الإمام الصيدلاني مذهبه في أكثر آرائه، وقد يوافق المذاهب الفقهية الأخرى، فهو كسائر المجتهدين لا يخرج عن مذهبه إلا نادرا. تناولت في هذا البحث بعض مسائله في القضاء منها جواز اتخاذ القاضي حاجبا وجواز عزل القاضي، وسماع الدعوى والبينة، على الغائب وعدم جواز الحكم على الخصم الحاضر مجلس الحكم قبل سؤاله. ولا بد من ذكر الجحود في الدعوى على الغائب عند إقامة الدعوى،
