احتلت أحكام الأسرى نصيباً وافراً في التنظيم الإسلامي للحرب، لأن الأسر أحد الآثار التي تخلفها الحروب، فما من حربٍ إلا وَتُخَلِّفُ أسرى من الجانبين. وأقر الإسلام للأسرى كرامتهم، ولم يهمل إرادتهم، وأمر المسلمين بحسن معاملتهم ، وإكرامهم، ولعل الحروب والنزاعات الحديثة بكل ما فيها من مآسٍ تُظْهِرُ الوحشية التي تتعامل بها الدول مع الأسرى، من قتلٍ وتعذيبٍ وما إلى ذلك. جاء الإسلام وأقر للأسرى كرامتهم بشموله لكل جوانب الحياة المختلفة، وربطه أمور الدنيا بأحكام الدين، فقرر لهم حقوق عند عملية الأسر، وحقوقاً أخرى تتعلق بالمكان الذي يعتقل فيه الأسير، إضافة إلى كيفية المعاملة التي يعامل فيها، كل ذلك بظاهر إنسانية فاقت الوصف، تلك المظاهر التي تضمن للأسير كرمته واحترامه وآدميته. المشكلة التي يحاول البحث إبرازها هو إيجاد حل للتناقض الغريب بين ما يقرره الإسلام وما يطبق على أرض الواقع، فما زالت معسكرات الأسرى في أغلب دول العالم تعج بالعديد من الممارسات الوحشية التي تفقد الأسرى كرامتهم، وتطغى على إنسانيتهم ، فجاء هذا البحث ليبرز التوافق بين الأسير باعتباره عدوا يقاتل في جيش الأعداء، وبين كونه أسيراً ضعيفاً لا حيلة له ولا قوة يخضع لإمرة المسلمين.
