المستخلص: تحرص المجتمعات المتحضرة على ضمان حقوق كل فردٍ منها مهما كانت مكانته في المجتمع، بل إنها تولي اهتماما خاصاً لتلك الفئات غير القادرة على تلبية حاجاتها بشكل ذاتي وذلك لعجزها الجسمي أو المعنوي. وهو الأمر الذي أضحى مكرساً له أكثر من أي وقت مضى في ظل سياقٍ دولي تعولمت فيه حقوق الإنسان بشكل غير مسبوق، إذ صار لزاما على كلِّ دولة أنّ تحترم حقوق وحريات مواطنيها بدون تمييز أو تفرقة, وتشكل فئة ذوي الإعاقة في هذا السياق جزءاً مهما من أي مجتمع، تتطلب أكثر من غيرها حماية خاصة؛ ورعاية متكاملة من طرف الدولة والمجتمع على حدٍّ سواء بالنظر لهشاشة وضعها وخصوصية احتياجاتها النفسية والمادية.
ولذا فإن هذا المقال سيحاول البحث في الوضعية الحقوقية لهذه الشريحة في الجزائر؛ من خلال فحص الإطار القانوني الذي رصدته الدولة الجزائرية للعناية بهذه الشريحة من المجتمع، ومحاولة الوقوف عند أهم التدابير القانونية والرعائية التي إتخذتها الحكومة بغرض حماية حقوق هذه الفئة، والعمل على دمجها وترقيتها في المجتمع.

Toute nation civilisée veille pour garantir les droits de leurs individus quelle que soit leurs conditions dans la société, de plus ; elle accorde une attention particulière aux personnes vulnérables qui sont incapables de satisfaire leurs besoins de manière autonome et durable à cause d’unhandicap physique ou moral, Notamment ; dans le contexte international actuel caractérisé par la mondialisation des droits de l'homme d’une façon sans précédent, où il est devenu incombe à chaque nation qui respecte les droits et libertés de ses citoyens sans discrimination. Pour cela, la catégorie des personnes handicapées constitue une partie importante dans toute société, et exige plus que d'autres, une protection spéciale et un soin intégré par l'Etat et de même par la société, vue à la spécificité des besoins psychologiques et physiques de ses personnes.
Donc, cet article veut examiner la situation des droits de l’homme de cette catégorie en Algérie, en explorant le cadre juridique accordé par l'état algérien pour prendre soin de ses personnes, et les mesures juridiques et pastorales prises par le gouvernement afin de protéger les droits des personnes handicapés et les intégrer dans la société.

Civilized societies are keen to guarantee the rights of each individual, regardless of their position in society. Rather, they pay special attention to those groups who are unable to meet their own needs because of their physical or moral disability. This has become more enshrined than ever in an international context in which human rights have become unprecedented. Every State must respect the rights and freedoms of its citizens without differentiation or discrimination. In this context, the category of persons with disabilities is an important part of any society, which mostly require special protection and comprehensive care by both the State and society, given their vulnerability and the specificity of their psychological and material needs.
Therefore, this article will try to examine the legal status of this segment in Algeria by examining the legal framework that the Algerian State has monitored to take care of this segment of society and also try to identify the most important legal and welfare measures taken by the Government to protect the rights of this group and to work to integrate them and promote them into society.
