المستخلص: سعت الدراسة إلى توضيح أهمية وتأثير أهمية النظام القضائي في المستعمرات الأمريكية للفترة الممتدة بين عام 1763 – 1607 وهي الحقبة التي نشأت فيها ركائز وأسس النظم القضائية القانونية في المستعمرات، وقسمت الدراسة على مبحثين، تناول المبحث الأول في محورين الوضع، إذ تتبع المحور الأول الجذور التاريخية لتطور النظام القضائي في المستعمرات الأمريكية، وفيه سلط الضوء بصورة وجيزة على الكشوفات الجغرافية، وتأسيس الشركات التجارية التي أخذت على عاتقها نقل المستوطنين إلي الأراضي المستكشفة، فضلاً عن سن القوانين التي تنظم شؤون المستعمرات، ودرس المحور الثاني الإجراءات القضائية في المستعمرات الأمريكية وقسم المبحث على محاور عدة، درس المحور الأول الإجراءات القانونية، وألية تنظيم النظم القانونية التي تنظم شؤون سكان المستعمرات، وناقش المحور الثاني العقوبات التي تتخذ بحق الجناة ومرتكبي جرائم مخالفة الأنظمة والقوانين المعمول بها في المستعمرات، فيما درس المحور الثالث المحاكم في المستعمرات وطريقة تنظيمها وحراستها والدور الذي توديه في تخفيف حدة التوترات والصراعات التي تحصل داخل مجتمع المستعمرات، وشفع البحث بخاتمة حوت نتائج البحث التي توصل إليها الباحث.

The American colonies of justice system of the impor¬tant topics for study and analysis on the grounds that the history of that system first start came in line with the emerg¬ing and formation of Modern those colonies, knowing that the court system in the colonies do not get out of the Eng¬lish courts, and even the characters who responded to that system was mostly received their education and training in universities and the English courts and laws* so that justice system of the starch colonies along the lines of the English system, colonies Enjoyed as they arise freely and wide to pursue ways and manage own in accordance with the ten¬dencies and the circumstances surrounding them, particu¬larly since the government of England was not directly in¬volved in the establishment of any of the colonies except colony of Georgia, as well as adherence to the first settlers, including inherited rights, relying on the king told James I, who I suppose that the people of the colonies are not sub¬ject to censorship, but soon the government aired in Eng¬land in 1651 at the age under which laws to regulate aspects of economic and political life, judicial administration in the colonies and pushed councils elected representative of the people of the colonies To work according to the laws English have produced followed regulatory procedures in the colonies for the emergence of problems within the limits of their application, generating a need for a judicial system seen in the colonies issues and resolved, often encountered in the Governor General of the colony in colonies properties King (New York. New Jersey. Virginia. North Carolina. South Carolina . Georgia. New Hampshire, and Masachosest) and in the colonies owned by individuals and companies such as (Maryland. Delaware, and Pennsylvania) several problems.
