المستخلص: L'article confronte les finalités initiales de la peine privative de liberté aux résultats obtenus par son application, et s'interroge sur leur concordance. L’empiètement des objectifs de rétribution et de neutralisation sur ceux de l’amendement et de la réhabilitation, fait craindre à une utilisation davantage mue par des considérations pragmatiques de sécurité, que par une appréhension réfléchie du phénomène criminel. Le crime n'ayant pas régressé par l'utilisation de cette peine, et l'atteinte au droit à la liberté étant toujours en inflation ; l'on s'interroge sur l'utilité de la peine privative de liberté, et sur la part d'importance octroyée à chacune de ses finalités.

The article confronts the initial purposes of the sentence of deprivation of liberty with the results obtained by its application, and questions their concordance. The encroachment of the objectives of retribution and neutralization on those of amendment and rehabilitation, raises fears of a use driven more by pragmatic security considerations, than by a thoughtful apprehension of the criminal phenomenon. The crime not having regressed by the use of this punishment, and the infringement of the right to liberty being always increased; one wonders about the usefulness of the sentence of the deprivation of liberty, and about the importance given to each of its purposes.
