المستخلص: إن هذه الدراسة لا تستهدف استقراء مدى الملاءمة بين ما تقرره المعاهدات الدولية التي صادقت عليها دول مجلس التعاون في نصوصها وبنودها مع التشريعات الوطنية؛ إذ الأجدى في ذلك استقراء وتحليل الإشكالات الدستورية والتشريعية التي تحول دون تحقيق الأثر المباشر للمعاهدات الدولية البيئية وغيرها، بما فيها المتعلقة بالحوادث والكوارث في التشريعات الوطنية لدول مجلس التعاون من خلال دراسة تحليلية ومقارنة. إذا كانت سيادة الدول تستلزم إقرار نظامها القانوني الذي ينظم مختلف الجوانب في المجتمع بصورة شخصية نظراً لاعتبارات السيادة، فلابد من التأكيد على أن ما يتعلق بالجوانب البيئية وعلى وجه التحديد ما يتعلق بقضايا الحوادث والكوارث لابد –وأن ارتبط ببعد اقتصادي يقترن بالتكلفة –أن يقترن ببعد دولي يتحقق من خلاله سمو القواعد القانونية الدولية المتعلقة بالبيئة وقضايا الحوادث والكوارث على وجه التحديد، حيث إن قضايا الحوادث والكوارث يمثل تنسيق الجهود الإقليمية والدولية فيها حجر الزاوية الذي ينبغي ان يرتبط بتعزيز البعد الوقائي للبيئة؛ نظراً لما يترتب على الحوادث والكوارث البيئية من تداعيات وآثار تصعب معالجتها بإعادة الأمور إلى ما كانت عليه، مما يستلزم ضرورة تجاوز الإشكاليات الدستورية والتشريعية لتحقيق الأثر المباشر للمعاهدات الدولية المعنية بالبيئة والمرتبطة بقضايا الحوادث والكوارث من خلال تعزيز الأدوات والاستعدادات الكفيلة بتعزيز نطاق هذا الأثر على التشريعات الوطنية، مع ربط ذلك ببرنامج عملي يستوعب توظيف التكنولوجيا الحديثة والعمالة الفنية المدربة التي ينبغي أن تقوم بجهود تقترن بالتنسيق الإقليمي والدولي في سبيل تحقيق أهدافها ضمن بعد استراتيجي دولي مدروس يستوعب بمعطياته ما تتبناه الكيانات الإقليمية والتي منها دول مجلس التعاون ضمن هذا النطاق. ومن جانب آخر تعكس جهود مملكة البحرين في مكافحة الحوادث والكوارث الطبيعية والصناعية دوراً يستهدف تحقيق الملاءمة بين ما ورد في بنود المعاهدات والاتفاقيات المتعلقة بالحوادث والكوارث التي صادقت عليها، وبين تشريعاتها التي تصدرها فيما يتعلق بالجانب السيادي والجانب الإجرائي لهذه الاتفاقيات، حيث سبق البيان بأن القيمة القانونية للاتفاقية الدولية تتحقق على أرض الواقع وفق ما قرره الدستور البحريني بصدورها بقانون؛ لذلك فإن مملكة البحرين أصدرت العديد من القوانين واللوائح والقرارات لتحقيق الملاءمة بين تشريعاتها وبنود ما صادقت عليه من معاهدات واتفاقيات بيئية، خاصة تلك المتعلقة بالحوادث والكوارث، والتي منها الإقليمية ومنها الدولية، كما تبنت مملكة البحرين جهوداً تنفيذية لتنفيذ تشريعات الملاءمة على أرض الواقع، وذلك من خلال تشكيل اللجان وتدشين الاستراتيجيات وإعداد الدروس المسحية دعماً للبحوث والبرامج العلمية، حيث تعكس هذه الجهود أخذ مملكة البحرين بالتوصيات الصادرة عن اللقاءات العلمية والمؤتمرات المعنية بالحوادث والكوارث الطبيعية والصناعية .

This study is not designed to extrapolate the appropriate extent of what is determined by international treaties ratified by the GCC states in its texts and its provisions with national legislation; it useful in so extrapolate and analyze the constitutional and legislative problems that prevent the direct impact of international environmental treaties and others, including related accidents and disasters in the national legislation of the GCC countries through analytical study and comparison. If the sovereignty of states require the adoption of its legal system, which regulates the various aspects of the community in person due to considerations of sovereignty, it must be emphasized that with regard to the environmental aspects and specifically with regard to accidents and disasters issues must t though has been associated with an economic dimension coupled with cost t be accompanied international dimension is achieved through which His Highness the international legal norms relating to the environment and issues of accidents and disasters specifically, since the incidents and disasters issues is the cornerstone on which should be linked to the strengthening of the preventive dimension of the environment; in view of the consequences of accidents and environmental disasters of the repercussions and the effects of the coordination of regional and international efforts in difficult to process the return things to what it was, necessitating the need to overcome the constitutional and legislative problems to achieve the direct impact of international treaties concerned with environment and related accidents and disasters issues through enhanced tools and preparations to enhance the scope of the impact on national legislation, with a link this practical program absorbed by the employment of modern technology and employment of trained technical which should be accompanied by the efforts of regional and international coordination in order to achieve their goals within the strategic dimension of an international thoughtful accommodate Bmattyate as adopted by regional entities from which the GCC countries within this range. On the other hand the efforts of the Kingdom of Bahrain reflect in the fight against accidents and natural and industrial disasters role aimed appropriate to achieve between the provisions of treaties and conventions relating to accidents and disasters that have ratified the terms, and the legislation issued with respect to side the sovereign side motion of these agreements, where previously the statement that the legal value international Convention materialize on the ground, according to the decision of the Bahraini Constitution publication cycle law; therefore, the Kingdom of Bahrain has issued a number of laws, regulations and decisions appropriate to achieve between the legislation and the terms of what it has ratified treaties and environmental agreements, especially those related to accidents and disasters, from which regional and including international, as adopted by the Kingdom of Bahrain executive efforts to implement adequate legislation on the ground, through the formation of committees and launch strategies and prepare lessons Survey in support of research and scientific programs, where these efforts reflect take Bahrain recommendations of scientific meetings and conferences on accidents and natural and industrial disasters .
