|a مما تقدم في المباحث والمطالب توصل البحث إلى النتائج الآتية: 1-المخدرات هي كل مادة تدخل جسم الإنسان، وتعمل على تعطيل واحدة من وظائفه أو أكثر، ومنه جميع الأدوية والعقاقير المؤثرة في الحالة الجسمية والنفسية، سواء كانت سائلة أو أقراص أو مسحوقاً أم غازاً أم حقناً أي بكافة أنواعها المعروفة. 2-يجوز التداوي بالمخدرات للضرورة والحاجة، وضمن ضوابط محددة وهو من باب التداوي بالحرام من أجل المصلحة والعلاج، سواء كانت المخدرات طبيعية أو مصنعة. 3-اتفق الفقهاء على عقوبة متناول المخدرات لغير التداوي، لكنهم اختلفوا في تحديد العقوبة، فقال بعضهم بالحد كالخمر، وقال البعض الأخر بالتعزيز بما يراه الحاكم. 4-إن تاريخ ظهور بعض أنواع المخدرات قديم جداً يصل إلى 4000 سنة ق. م، فقد عرفه السومريون والمصريون والإمبراطورية الإغريقية والرومانية، واستخدمه الأطباء مثل ابن سينا في علاج الأمراض. 5-إن فوائد المخدرات طبياً أكثر بكثير من فوائد الكحول، وليس للكحول إلا بعض الفوائد الصناعية البسيطة نسبياً. وهذا مصداق قوله تعالى: (وَإِثْمُهُمَا أَكْبَرُ مِنْ نَفْعِهِمَا). وبالرغم من أن فوائد المخدرات أكثر من المسكر، وإضرار المسكر أكثر منها، ومع ذلك، فإنهم منعوا المخدر وسمحوا للمسكر. وهذا في الحقيقة من الانحراف في النظر إلى الكون والحياة. 6-إن أهم أدلة حرمة استعمال المخدرات ناظرة إلى حصول الضرر من الاستعمال بصفته مصداقاً من التهلكة المنهي عنها في الآية الكريمة وهو لا يحصل بالمرة والمرتين وإنما يحتاج إلى تكرار الاستعمال مرات عديدة.
