المستخلص: فلقد جاءت تعاليم الإسلام ومبادئه السمحة، ومقاصده العظيمة لتحفظ للناس دينهم وتصون حقوتهم وترشدهم لما ينفعهم في الدنيا والأخرة. ولما كان الإرهاب اعتداء على الناس وأموالهم وانتهاكاً لحرماتهم، كان عن الضروري أن تتضافر الجهود لدفعة والقضاء علية حمايتاً للناس وتحقيقاً لمصالحهم المختلفة، ولقد بذلت العديد من الدول جهوداً مختلفة ومتنوعة في هذا المجال في محاولاً لإيجاد الحلول والآليات المناسبة لمواجهته والقضاء عليه، فسلطت أشد العقوبات، وفرضت إجراءات صارمة في المتابعة والتحقيق، ولكن هل توقف الإرهاب ؟.. . إن التشريعات التي صدرت في مواجهة الإرهاب يطلق عليها إن صح التعبير تشريعات الصدمة، وهي تشريعات في الحقيقة عكست ارتباك المشرع وأظهرت أن الإجراءات المتخذة والعقوبات المفروضة لم تكن نابعتاً من دراسة صحيحة للظاهرة، لذلك ها هو الإرهاب في كل مرة يظهر من جديد شكل مختلف متخذاً أبشع أساليب التخويف والتخريب. ولأن الوقاية خير من العلاج كان لزاماً البحث في مسببات الظاهرة الإرهابية وتشخيصها، ومن ثمة وضع التدابير المناسبة للحيلولة دون ظهورها وتفشيها، وهو ما تفطنت له بعض الدول مثل الجزائر - وإن كانت متأخرة- وبعض الدول العربية الأخرى فسارعت إلى بعث التنمية الاقتصادية عن طريق العديد من البرامج الموجهة إلى الشباب، وبرامج أخرى لدعم الاقتصاد الوطني والقضاء على البطالة..، من جهة ومن جهة أخرى سنت العديد من القوانين الوقائية من الإرهاب وكذا اتخاذ العديد من الإجراءات الرامية لتجسد مفهوم دولة القانون..، ومن هنا تبز الإشكالية التي نحاول الإجابة عنها في هذه الورقة والتي تتمحور حول الكشف عن سياسة التدابير الوقائية وأهميتها في مواجهة الإرهاب؟

All praise is due to Allah and peace and blessing be upon His last Prophet, his family, and his companions. The teachings of Islam and its principles of tolerance have emphasized the importance of securing human rights and believes, and guiding them to what is good for them in this world and the hereafter. Since terrorism is considered as an attack on humans and their possessions, and a violation of their sanctities, it is necessary to increase the efforts to eliminate it in order to protect humanity. Many countries made great efforts in this area in an attempt to find solutions mechanisms to confront and eliminate terrorism These countries imposed sever punishments and strict procedures in dealing with the phenomenon, but hasterrorism stopped? The legislations passed in the face of terrorism are called Shock Legislations. In fact, these legislations reflected the confusion of the legislators and showed that the actions taken and the penalties imposed were not based on adeep study of the phenomenon. This is one of the reasons why terrorism appears every time in a new form using the ugliest methods of sabotage and Intimidation. Because prevention is better than cure it became necessary to search for the causes of the phenomenon of terrorism, and then to develop appropriate measures to prevent the emergence and spread of it which many countries noticed such as Algeria -although late. Thus, some other Arab states rushed to push economic development forward by many programs aimed at young people, and many other programs that support the national economy and reduce unemployment. On the other hand, these countries enacted many preventive laws against terrorism, as well as taking several measures designed to embody the concept of the rule of law. Hence, the aim of this paper is to evaluate the policy of thesepreventive measures and their role in facing terrorism?
