تقضى القواعد النموذجية الدنيا لمعاملة السجناء التي تمثل في جملتها الشروط الدنيا التي تعترف الأمم المتحدة بصلاحها والتي تنطبق على جميع المحرومين من حريتهم. والتي استكملت بمعايير أخرى اعتمدتها الأمم المتحدة، منها "مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال لاحتجاز أو السجن، والمعايير المتعلقة بحماية جماعات معينة مثل لأطفال. وعلى الرغم من انتهاء حرب تحرير الكويت عام 1990م مازالت آثار هذا العدوان ماثلة أمام العيون وجرح غائرا في جبين الوطن العربي، حيث لا يزال هناك في السجون العراقية أسرى كويتيين، مما جعل هذه المسألة تحتل أهمية خاصة على الساحة الدولية والإقليمية. ومما يجدر ذكره، أن عمليات التصفية والاغتيالات التي تمارسها السلطات الإسرائيلية تعد – انتهاكاً صارخاً لحقوق الإنسان والقانون الدولي الإنساني وقد أدت عمليات التعذيب للأسرى في السجون والمعتقلات الإسرائيلية وفرض ظروف اعتقال قاسية تتسم بالبطش والإهمال الطبي المعتمد. ولهذا فإن المعتقلين في قاعدة جوانتانامو الأمريكية تنتهك حقوقهم ولا يعاملوا معاملة" أسير حرب " بل يستعمل معهم كل أشكال التعذيب. ولذلك فإن قواعد القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني والمواثيق الدولية تنتهك في قاعدة جوانتانامو, يعد توفير ظروف معيشية لائقة في أماكن الاحتجاز أمراً ضرورياً للحفاظ على الكرامة الإنسانية للشخص المحتجز.
