تتنوع العقوبات في الإسلام إلى ثلاثة أنواع؛ حدود، وقصاص، وتعزير، ولكل نوع منها أحكامه التي يختلف فيها عن غيره، أو يشترك معه فيها؛ بناء على كون الحق في إقامة هذه العقوبات راجعا إلى الله تعالى وهو المعبر عنه بحق المجتمع، أو كونه راجعا إلى العبد. وقد بينت الدراسة معنى الحق وأقسامه، والثمرات التي انبنت على تقسيم الحق إلى حق الله تعالى، وحق العبد، كما بينت أن الضابط في تمييز ما هو حق لله تعالى من العقوبات عما هو حق للعبد أمران: أحدهما: مدى احتياج الناس لذلك الأمر، والخطورة التي تسببها الجريمة للمجتمع، والثاني: مدى جواز تصرف العبد في الحق بالإسقاط، والعفو، والصلح وغيره. إن تقسيم الحق إلى حق الله وحق العبد ينبني عليه عدد من الآثار الفقهية، وكان له أثر في اختلاف الفقهاء في مسائل فقهية في باب الحدود بينتها الدراسة؛ وهي: أثر تقسيم الحق إلى حق الله وحق العبد في العفو عن العقوبة، وفي تنفيذ الحد، وفي تداخل الحدود، وأولوية تنفيذها، والأثر الفقهي لاختلاف الفقهاء في مرجعية الحق في حد القذف.
