تعد المياه من أهم الموارد البيئية، فهي أساس الحياة، قال تعالى؛ و(جعلنا من الماء كل شيء حي) (الأنبياء 30) وان قضية تلوث المياه وما تعانيه من تدهور واستئناف وسوء استخدام أصبحت من القضايا الملحة في عالما المعاصر، ولهذا طرح هذا البحث مشكلتين خطيرتين تهددان هذا المصدر البيئي الحيوي وهما؛ تلوث المياه واستنزفها. وقد تناولت هذه الدراسة أهمية المياه كعنصر بيئي، وبينت الأخطار المترتبة على تلوثها واستنزافها، كالتصحر والفضاء على الثروة النباتية والحيوانية والبحرية، واختلال التوازن البيئي، وخلصت إلى حرمة تلويث المياه استنزافها وبينت الدراسة أن النفايات بأشكالها المتعددة من قمامة ومخلفات مصانع، ومياه الصرف الصحي الملوثات النووية والإسراف في استخدام المياه من أهم مسببات تلويث المياه واستنزافها. كما عرض البحث أهم القواعد والمبادئ والمنطلقات والسبل والإجراءات الشرعية التي يستند إليها في الحفاظ على الثروة المائية، كالنهي عن الإسراف، ومنع ما يؤدي إلى تلويث المياه، ومنع احتكار الموارد المائية، وتشجيع حفر الآبار، بالإضافة للقواعد الفقهية كقاعدة "لا ضرر ولا ضرار" وقاعدة درء المفاسد مقدم على جلب المصالح وقواعد تقييد التصرف بالملكية الفردية إذا ألحق هذا التصرف ضررا بالغير، فضلا عن دور السياسة الشرعية في اتخاذ ولي الأمر من الإجراءات ما يكفل المحافظة على هذا المورد الهام.
Water is considered as the most important environmental resources, it is the cornerstone of life, Allah says, "We made every living thing of water" Alanbya 30. The issue of pollution, suffering from degradation and depletion as well as misuse of water has become one of the important issues in our contemporary world. So, this research consists of two serious problems threatening this environmental and biological source. However, these problems are pollution and depletion of water. This study deals with the importance of water as an environmental part and this study also demonstrated the dangers of pollution and depletion, such as desertification, eradicating of plant, animal, marine wealth, and ecological unbalance. So the study concluded with the sharia prohibition of water pollution and depletion. The study have showed that multiple forms of waste like garbage, waste water, nuclear contaminants and excessive use of water are the most important causes of water pollution and depletion. The researcher also presented the most important rules, principles approaches,ways and Sharia procedures as the bases for preservation of water resources like forbidding of extravagance, and preventing that which leads to contamination of water, as well as preventing monopoly of water resources, and encouraging the drilling of wells, in addition to the rules of jurisprudence as the rules "do no harm" and "precautionary procedures are better than bringing benefits" as well as the rules of private ownership restrictions if this act caused damage to others and the role of Sharia policy in making decisions by governor to maintain that important resource.
