This research examines the issue of the down payments sale from the perspective of hadith science. This is done through the collection of the relevant hadiths in this field, which were used by the scholars of Fiqh as evidences of allowing or prohibition. The research is titled “The effect of the weak hadiths on the schools of Fiqh: An applied study on the down payments sale”. The research included an introduction and two topics. The introduction discussed the validity of the weak hadiths, and the definition of the down payments sale, The first topic includes a critical study in the field of hadith regarding the four hadiths related to the down payments sale. Three of these hadiths allow this kind of sale, while one prohibits it. The second topic includes a study on the impact of these hadiths on the different schools of Fiqh, including using them as evidences despite their weakness, It has been concluded that all the narrations mentioned in the field of the down payments sale are criticized in a way or another. This could be due to a hidden weakness (Illah), which affects validity of the hadith in both allowing and prohibition aspects. The study recommended researchers in the field of hadith to establish a comprehensive project in this regard in order to examine the relationship between hadith and the contemporary issues of Fiqh, which people need in their worship and daily life.
يدرس هذا البحث مسألة بيع العربون من ناحية حديثية نقدية, وذلك من خلال جمع الأحاديث الواردة في هذا الباب, والتي استدل بها الفقهاء, وكان لها أثر فيما ذهبوا إليه من الإباحة أو التحريم. وأسميته: "أثر الأحاديث الضعيفة على المذاهب الفقهية, دراسة تطبيقية على بيع العربون", وقد اشتمل هذا البحث على مبحث تمهيد: وفيه حكم الاحتجاج بالحديث الضعيف, وتعريف بيع العربون لغة واصطلاحاً. وأما المبحث الثاني: ففيه الدراسة الحديثية النقدية للحديث الوارد في النهي عن بيع العربون, وأثر ذلك على الفقهاء, وأما المبحث الثالث: ففيه ثلاثة أحاديث في الإباحة, وأثرها على الفقهاء. وقد تبين أن كلَّ ما ورد في بيع العربون من الأحاديث لا يسلم من مقال, أو علة قادحة تستوجب ترك الاحتجاج به في هذا الباب, سواء في الإباحة للعربون أو التحريم له. وأوصت الدراسة الباحثين إلى المختصين في الحديث الشريف وعلومه, بالعمل على مشروعٍ حديثيٍّ نقديٍّ شاملٍ للتراث الفقهي, بخاصة الأحاديث المتعلقة بالمسائل التي تواكب العصر, ويحتاجها الناس في عباداتهم ومعاملاتهم.
