The principle of pacta sunt servanda of the most important rules that contracts control, but it gives both the contractor the right to stick to what is stated in the contract, which could harm the other party, or to exaggerate in upholding their rights arising out of the contract, so I had to make the existence of another principle reduces the severity, a principle of good faith in the contract, so as not to overestimate one of the parties upon execution is holding provisions of the contract, or overestimate his rights arising out of it, or exhausting other contracting his demands, and the principle of good faith and that it was ethical principles, only to put it in legal texts, removed from the tidy moral obligation to the status of the legal obligation which ranks effects on the limbs, and the principle of good faith distinctive character in Islamic law differs from the laws; therefore this research are exposed to these aspects, which is characterized by the principle of good faith in Islamic law for in the law for commercial contracts.
إن مبدأ العقد شريعة المتعاقدين من أهم القواعد التي تحكم العقود، إلا أنه يمنح كلا من المتعاقدين حق التمسك بما ورد في العقد, مما قد يضر بالطرف الآخر, أو أن يغالي في التمسك بحقوقه الناشئة عن العقد, ولذا كان لزاماً وجود مبدأ آخر يخفف من حدته, وهو مبدأ حسن النية في العقد, حتى لا يغالي أحد الطرفين عند التنفيذ فيتمسك بنصوص العقد, أو يغالي في حقوقه الناشئة عنه, أو يرهق المتعاقد الآخر بطلباته, ومبدأ حسن النية وإن كان من المبادئ الأخلاقية، إلا أن وضعه في نصوص قانونية، ينقله من مرتبة الالتزام الأخلاقي إلى مرتبة الالتزام القانوني الذي يرتب آثاراً على أطرافه, ولمبدأ حسن النية طابع مميز في الشريعة الإسلامية يختلف عن القوانين؛ ولذا فإن هذا البحث يتعرض لهذه الجوانب التي يتميز بها مبدأ حسن النية في الشريعة الإسلامية عنه في القانون, فيما يتعلق بالعقود التجارية.
