المستخلص: This paper titled “Woman travel without an unmarriageable person (Mahram) between the jurisprudence context and the contemporary reality; an objectives doctrine study” handles a set of aspects. It demonstrates the primary concepts by knowing and understanding the reality of the jurisprudence and its correlation with Islamic law objectives through describing their effects while dealing with the context in jurisprudence and practice sides. In addition to the importance of considering Islamic law objectives when explaining the meaning of the Islamic legal texts and showing the relationship between the text and the benefit and the benefit by text. This study also mentioned the previous predecessors and descendant scholar’s opinions that clarify and explain the Islamic law about woman travel without aMahram. Furthermore, study this subject practically from the hadith and jurisprudence perspectives while taking into account the jurisprudence of the objective and reality. Finally, the paper exhibits the flexibility of the Islamic jurisprudence when dealing with the recent and new issues, explaining at the same time the strong correlation between the wisdoms and the wholeness objectives of the Islamic legislation from one side and jurisprudence of the reality from the other side, and its effects in understanding and explaining the reasons of the legislation rules.

تناول هذا البحث "سفر المرأة بلا محرم بين النص الفقهي والواقع المعاصر" دراسة فقهية مقاصدية"، عدة محاور وضحنا من خلالها ما يأتي: بيان المفاهيم الأساسية من معرفة ماهية فقه الواقع، ومدى ارتباطه بمقاصد التشريع من خلال بيان أثر مقاصد التشريع في التعامل مع النصوص فقها وتنزيلا، وضرورة الالتفات إلى مقاصد التشريع لتفسير النصوص الشرعية، واظهار علاقة النص بالمصلحة، والمصلحة بالنص. وعرض لأراء من سبقنا من فقهاء السلف، ومن جاء بعدهم من فقهاء الخلف، فيما تطرقوا إليه من بيان حكم سفر المرأة بلا محرم قديما وحديثا، ودراسة المسألة دراسة تطبيقية من ناحية حديثية فقهية مراعين في ذلك فقه المقصد وفقه الواقع؛ وبيان مدى مرونة الفقه الإسلامي في التعامل مع القضايا المستجدة، وإيضاح العلاقة الوثيقة بين الحكم التشريعية والمقاصد الكلية للتشريع من جهة وفقه الواقع من جهة أخرى، وأثرها في فهم الأحكام الشرعية وتعليلها.
