تتكون العملية الاجتهادية من مرحلتين هامتين لا تنفك إحداهما عن الأخرى، ولا تكتمل إحداهما دون الأخرى، ألا وهما الاجتهاد الاستنباطي والاجتهاد التطبيقي، وقد عالجت دراسة سابقة المرحلة الثانية منهما ألا وهي الاجتهاد التطبيقي أو التنزيلي من حيث المعايير التي لابد للمجتهد التطبيقي منها عند نظره في المسألة محل الحكم وواقعها، والظروف المحتفة بها وما أحاط بها من قرائن وتوابع تؤثر في حكم هذه المسألة، وقد خلصت تلك الدراسة إلى أن هناك نوعين من المعايير التي لابد من رعايتها عند النظر في الوقائع وتنزيل الأحكام عليها؛ ألا وهي المعايير الموضوعية والمعايير الشخصية، وبعد بيان المراد من هذه المعايير وأنواعها جاءت هذه الدراسة لبيان التأصيل الشرعي لها من كتاب الله، وسنة رسوله صلى الله عليه و سلم وفقه الخلفاء الراشدين والصحابة المهتدين بما ينهض بتأصيل شرعي لها يشهد بمشروعيتها واعتبارها ويتبدى بوضوح رعاية الشارع الكريم لها.
