المستخلص: The " investment license " considered one of the most important subjects , since the legislation embodied one of the basic elements to the environment of investment, like in political , economic , cultural , and security field . The investor often need to check on his financial assets which composed his investing project , as well as need legislation do not enumerated conditions lead to alienate his investment project whether confiscation , nationalization , withdrawing his investment commission. The importance of withdrawal of investment license lies in the importance of investment in modern era. since the investment swept all over the countries and the countries compete to attract the foreign investments in order to achieve the economic growth or developed it through attract the money , modern technology ,and employment all these factors pushed the countries in order to enact the laws related with investment. Iraq, like the other third countries Iraq was look to foreign investment as colonial tool this effect on Iraq culture even in legal side , many laws has been enacted like Act No. 20 of 1998 ( industrial investment for the private and mix sectors Act ) this Act related with local investment only as well as the Act No. 62 related with Arabian investment. After regime change in Iraq 9/ 4/ 2003 , the order of coalition authority No. 39 of 2004 , the investment Act No. 13 of 2006 ,and the order No. 2 of 2009 issued to fit the requirement of Market economy as the modern economics in contrary with socialist economy, although the legal side of investment still need many of studies and researches in order to bridge the gab especially in related with withdrawal the investment license.
