|a موضوع المصلحة المرسلة من الموضوعات التي لقيت حظا وافرا من الدراسات المعاصرة، فضلا عن أنها حاضرة في كتب أصول الفقه التي تبعت مدرسة " الجويني-الغزالي " الأصولية، قديما وحديثا. \nوعلى الرغم مما كتب حول المصلحة المرسلة إلا أن الجانب التاريخي لهذا المصطلح على أهميته لم ينل حظه من البحث. \nوهذا البحث يهدف إلى دراسة نشأة مصطلح "المصلحة المرسلة " وتطوره، بغرض إظهار السياق التاريخي لظهوره، ومكانته في الفكر الأصولي، ومعرفة سبب الاضطراب الحاصل في نسبة الاحتجاج به إلى أصحاب المذاهب الفقهية. \nأما منهج: البحث فيقوم على تتبع مواطن الحديث عن المصلحة المرسلة في الكتب الأساسية للمتقدمين من الأصوليين؛ سعيا للتعرف على زمن ظهور هذا المصطلح والتطور الذي خضع له، مع تخصيص ما كتبه الجويني والغزالي بالعرض والتحليل؛ لكون تلك الكتابات تمثل المادة الأساس لهذا الموضوع. \nوأهم النتائج التي خلص إليها البحث: أن مصطلح "المصلحة المرسلة " نشأ وتطور في مدرسة الجويني -الغزالي الأصولية (وانتشر بعد الغزالي عند الأصوليين الذين تأثروا بتلك المدرسة، وأنه لا وجود لمصطلح المصلحة المرسلة وما يتعلق بها في أصول المالكية إلى عصر ابن العربي، وإنما دخل القول بالمصلحة المرسلة كتابات علماء المالكية الذين تأثروا بمدرسة الجويني -الغزالي الأصولية. وأن أهم سبب في الاضطراب الذي وقع في نسبة القول بالمصلحة المرسلة إلى أئمة المذاهب الفقهية يعود إلى إسقاط المفاهيم التي أنشأها المتأخرون على اجتهادات المتقدمين، والأثر السلبي للأمثلة التي نسبها الجويني إلى مالك، والأمثلة التي ناقش الغزالي من خلالها موضوع المصلحة المرسلة.

|f The subject of (Maslaha Mursala) public interest is among the subjects that have been received ample interest in contemporary studies, as well as that they are present in the books of the fundamentals of jurisprudence, which followed the fundamental school "Juwaini-Ghazali", in the past and in present.\nDespite what has been written about (Maslaha Mursala) public interest, the historical aspect of this term despite its importance has not been explored.\nThis research aims to study the origin of the term (Maslaha Mursala) public interest and its development, in order to show the historical context of its emergence, its place in Usooli (principle of jurisprudence) thought, and to find out the cause of the confusion in the attribution of its invocation to the people of schools of jurisprudence.\nThe method of research is to trace the places of the Hadith about the public interest in the primary books of the early scholars of Usul (principles of Jurisprudence) in order to identify the time of the emergence of this term and the development it was subjected to, with the allocation of what Aljwaini and Ghazali wrote to present and analyzed, because these writings represent the basis of this subject.\nThe most important findings of the research are that the term "public interest" originated and developed in the school of Juwayni-Ghazali (and spread after al-Ghazali among the jurisprudents who were influenced by that school and that the term “public interest” was not found in fundamentals of al-Malikiyah till the era of ibn al-Arbi. Moreover, the discussion about the “public interest” in the books of those scholars of al-Malikiyah was brought by those were influenced by the school of Juwayni-Ghazali. The most important reason for the confusion that occurred in the attribution of the about public interest to the imams of the schools of jurisprudence is due to abolishment of concepts created by the latter scholars on the juristic opinions of the early scholars, and the negative impact of the examples that were imputed by Al-Juwaini to Malik, and the examples in which al-Ghazali discussed the issue of public interest.\nThis abstract translated by Dar AlMandumah Inc. 2018
