المستخلص: Algeria has made great strides in its negotiations with the World Trade Organization and consequently Algeria is obliged to implement all WTO agreements in accordance with the negotiations and commitments it has agreed to and accepted. The TRIPS Agreement is at the forefront of the agreements that will undoubtedly affect technology-intensive industries, particularly pharmaceutical industries, which have a close linkage to intellectual property rights, especially with regard to confidential (undisclosed) information. For this reason, the protection of confidential information (undisclosed) occupies an important place among the topics of industrial property and has become the most prominent incorporeal elements of industrial and commercial companies, as it provides them with a competitive advantage and commercial reputation vis-à-vis other competing companies and projects. Its importance increases at the international level and is considered to be the main focus in respect to the transfer of technology. That is as many technology producers prefer to keep their inventions secret, not disclose them and benefit from the protection afforded by industrial property rights laws and conventions.

La protection des renseignements non divulgues est considérées comme étant l’un des sujets les plus importants de la propriété industrielle, et il est devenu un élément moral nécessaire pour les entreprises industrielles et commerciales puisqu’il les accorde un avantage concurrentiel et une réputation auprès les autres entreprises et projets commerciaux. Cette protection devient de plus en plus importante à l’échelle internationale où elle joue un rôle principal dans le processus de transfert de technologie vu que la majorité des producteurs de la technologie préfèrent garder la confidentialité de leurs inventions ainsi de bénéficier de la protection offerte par les lois et les accords de la protection des droits de propriété industrielle.

لقد قطعت الجزائر شوطا كبيرا في مفاوضاتها مع منظمة التجارة العالمية، وعليه فإن الجزائر ملزمة بتطبيق كل اتفاقيات المنظمة وفق المفاوضات والالتزامات التي توافق عليها وتقبلها، وتأتي اتفاقية تريبس على رأس الاتفاقيات التي سوف تؤثر لا ريب في الصناعات الكثيفة التكنولوجيا لا سيما منها الصناعات الدوائية، التي لها ارتباط وثيق بحقوق الملكية الفكرية خاصة ما تعلق بالمعلومات السرية (غير المفصح عنها). لهذا تحتل حماية المعلومات السرية (غير المفصح عنها) مكانا هاما من بين مواضيع الملكية الصناعية وأصبحت أبرز العناصر المعنوية للشركات الصناعية والتجارية إذ تمنحها ميزة تنافسية وسمعة تجارية تجاه الشركات والمشاريع الأخرى المنافسة، وتزداد أهميتها على المستوى الدولي فتعتبر المحور الأساسي في عمليات نقل التكنولوجيا، حيث تفضل الكثير من الجهات المنتجة للتكنولوجيا الاحتفاظ باختراعاتها سرا وعدم الكشف عنها والاستفادة من الحماية التي توفرها قوانين واتفاقيات حماية حقوق الملكية الصناعية.
