Consequently the international organizations seeking through international conventions and urged States to enact legislation to reduce this phenomenon, this study has addressed the talk about the concept of human trafficking and historical development of the problem of trafficking in human beings, and then talk about the reference to combat human trafficking in the vision of Islamic jurisprudence, legal and images of human trafficking The causes and effects and the prohibition of human trafficking in Islamic law and man-made laws. The study concluded that Islamic law worked on drying all the headwaters of slavery, servitude, and international organizations seeking to combat this phenomenon. The study recommends the need to adhere to the principles of Sharia tolerant to eliminate this crime and enact laws at the local and international level that are struggling this crime and activate the protection methods of this crime.
من مزايا الشريعة السمحة أنها جاءت بأحكام سامية أغلقت منافذ الخلل، فالناس تحت مظلة الشريعة السمحة يتمتعون بكامل حريتهم قال تعالى: "يَا أَيُّهَا النَّاسُ إِنَّا خَلَقْنَاكُمْ مِنْ ذَكَرٍ وَأُنْثَى وَجَعَلْنَاكُمْ شُعُوبًا وَقَبَائِلَ لِتَعَارَفُوا إِنَّ أَكْرَمَكُمْ عِنْدَ اللَّهِ أَتْقَاكُمْ إِنَّ اللَّهَ عَلِيمٌ خَبِيرٌ " فهذه الآية وغيرها الكثير من الآيات تقرر وحدة الأصل للإنسان مما يقتضي عدم التمايز، ومن مظاهر تحريم الاسترقاق في الشريعة التحريم بكافة صور ومظاهر الاتجار بالبشر فالإنسان مخلوق مكرم لقوله تعالى: "وَلَقَدْ كَرَّمْنَا بَنِي آَدَمَ ". فظاهرة الاتجار بالبشر محرمة في الإسلام وهي من كبائر الإثم والفواحش. والإسلام يعمل بأحكامه ومبادئه على رفع الظلم والقهر عن الإنسان وإقامة العدل والكرامة والحرية للإنسان من حيث هو إنسان. وترتيباً على هذا تسعى المنظمات الدولية من خلال الاتفاقيات الدولية وحث الدول على سن التشريعات للحد من هذه الظاهرة، وقد تناولت هذه الدراسة الحديث عن مفهوم الاتجار بالبشر والتطور التاريخي لمشكلة الاتجار بالبشر، ثم الحديث عن مرجعية مكافحة الاتجار بالبشر في الرؤية الفقهية الإسلامية والقانونية وصور الاتجار بالبشر وأسبابه وأثاره وتحريم الاتجار بالبشر في الشريعة الإسلامية والقوانين الوضعية. وتوصلت الدراسة إلى أن الشريعة الإسلامية عملت على تجفيف كل منابع الرق والعبودية، كما تسعى المنظمات الدولية إلى مكافحة هذه الظاهرة. وتوصي الدراسة بضرورة الالتزام بمبادئ الشريعة السمحة للقضاء على هذه الجريمة وسن القوانين على المستوى المحلي والدولي التي تكافح هذه الجريمة وتفعيل أساليب الحماية من هذه الجريمة.
