|a إن التطور الهائل الذي عرفه العالم مؤخراً بصفة عامة والمجتمع الجزائري بصفة خاصة أدى إلى ظهور بعض الجرائم المستحدثة الخطيرة التي تهدد استقراره وكيانه، ولمحاربتها اعتمد المشرع الجزائري منظومة قانونية جديدة بتعديله لقانون العقوبات بموجب القانون 06 – 22 المؤرخ في 20/ 12/ 2006 أدخل فيها تقنيات جديدة للبحث والتحري عنها ومن بينها التسرب الذي يعتبر إجراءاً خطيراً لكونه يعد اختراقاً في أوساط المجموعات الإجرامية وكذا المساس بخصوصية الأفراد وحرياتهم عن طريق استعمال هوية مستعارة للعون المتسرب دون علمهم بهدف إثبات والكشف عن الجرائم ومرتكبيها، وبالتالي تم تغليب مصلحة المجتمع على المصلحة الخاصة للفرد، هذا ويبقى الدليل المستمد من هذا الأسلوب غير كاف في غياب أدلة أخرى تدعمه.

|f The recent dramatic developments in the world in general and Algerian society, in particular, have led to the emergence of some serious new crimes that threaten its stability and entity. The Algerian legislature has adopted a new legal system to combat them by amending the Penal Code in accordance with Act 06 - 22 of 20 December 2006 Introducing new research and investigation techniques. These include infiltration, which is considered a serious measure, as it constitutes a breach among criminal groups, as well as an infringement on the privacy and freedoms of individuals by using a pseudonym for the infiltration agent without their knowledge in order to prove and detect crimes and their perpetrators. Thus, the interest of society has prevailed over the private interest of the individual, and evidence from this method remains insufficient in the absence of further evidence to support it.\nThis abstract translated by Dar AlMandumah Inc 2018.

|d le développement phénoménal qu'a connue dernièrement le monde en général et la société algérienne en particulier a contribué à l'essor de nouvelle infractions graves qui constitue une menace sur sa stabilité et son entité, et pour lutter contre celle-ci le législateur algérien à mis en place un nouveau system juridique en modifiant le code de procédure pénal par la loi 06-22 daté du 20/12/2006 ou il a introduit de nouvelles techniques d'investigations et de recherches dont l'infiltration, qui est considéré comme une procédure grave puisqu'elle constitue une introduction dans le milieu des bandes criminelle ainsi qu'une atteinte au particularité des personnes et leurs libertés en usant une fausse identité par l'agent infiltrant à leur insu dans le but de prouver et découvrir les infractions et leurs auteurs, ainsi l'intérêt de la société à été prédominé sur celui de l'intérêt personnel de l'individu, cependant la preuve relevée par le biais de ce moyen est insuffisante en l'absence d'autres preuves pour la renforcer.
