مصلحة المحضون: مبدأ عرفته الشريعة الإسلامية، وبحثه الفقه، وأقرته القوانين المقارنة، وطبقه الفضاء المعاصر، بل أصبح هو المبدأ الأساسي الذي يؤخذ بعين الاعتبار عند إسناد الحضانة أو ممارستها أو إسقاطها أو إنهاءها ويقدم حتى على حقوق الحاضن والولي. كل ذلك حفاظا على حقوق الطفل المحضون، الطرف الضعيف المتضرر من إنهاء العلاقة الزوجية والتفكك الأسري، سواء بالطلاق أو الوفاة أو الفقدان، والقيام برعايته وتربيته على دين أبيه وتعليمه والإنفاق عليه والسهر على حمايته خلقا وخلقا جسما وعقلا، حتى يبلغ أشده ويتمكن من القيام بشؤونه بنفسه، والنهوض بتبعات الحياة ويتحمل مسؤولياته الفردية والمجتمعية. غير أن هذا المبدأ على الرغم من كل هذه الأهمية وتلك العناية المعطاة له مازال تكتنفه بعض العمومية وعدم التحديد الشيء الذي تهدف هذه الدراسة لإجلائه وإزالة الغموض عنه.
To comply with the basic necessities of brought up children is a concept clearly specified by Islamic legislation , studied by its jurisprudence , asserted by comparative laws and is fully applied by Modern courts . Moreover, it has become the main concept taken into account when deciding to assign this charge practice it, atop it or bring it to an end, having constantly is mind that the child advantages are prior to those of the tutor . All these considerations are intended to preserve the child rights ,since he is the weakest part bearing all the harm due to the breaking of the marriage ties and the family disruption whether as a consequence of divorce , death or disappearing in order to be brought up according to his father religion educated and with all the expenses conferred to the tutor who is caring for his safety in all regards body and mind ,until he reaches the age of self conceit and become able to manage for himself , facing the events of life and taking his personal and common responsibilities. In spite of all these considerations there are some unidentified aspects of this concept, which this study intends to clarify and make it more accessible.
