المستخلص: تناول البحث دراسة الكونفدرالية ومدى إمكانية تطبيقها على العراق-دراسة قانونية سياسية من خلال مقدمة ومبحثين، حيث أوردنا في الأول ماهية الكونفدرالية وخصائصها وبعض التطبيقات العملية للكونفدرالية؛ ودرسنا في المبحث الثاني انفصال الأقاليم الفدرالية في ضوء القانونين الدولي العام والدستوري، وكذلك مبررات تأسيس الكونفدرالية ومدى إمكانية تطبيقها على العراق. وقد استنتجنا في خاتمة البحث بأن الكونفدرالية تتميز عن المفاهيم الأخرى المشابهة لها كالفدرالية والمنظمات الدولية الإقليمية، حيث أنها تعد بمثابة جمعية دولية سياسية-قانونية وإحدى أشكال الاتحاد والتحالف الدولي تنشأ كنتيجة لظروف ومصالح واعتبارات خاصة في بعض مناطق العالم التي تعاني من مشاكل وأزمات سياسية واقتصادية (كما في الحالة العراقية الراهنة مثلا) وذلك من خلال معاهدة تبرم بين دولتين (وأحيانا ولايتين) أو أكثر تعهد بممارسة بعض صلاحياتها إل سلطة مشتركة بغية تسيير أمور الاتحاد وتحقيق أهدافها. وعليه في ضوء وجود عدد من المبررات المنطقية (الدستورية-القانونية والسياسية والأمنية والاقتصادية والاثنوغرافية) الحافزة، فقد أوصينا أخيرا بإمكانية تطبيق هذه التجربة على العراق وتأسيس اتحاد كونفدرالي فريد في مناطق العراق الثلاث (إقليم كوردستان والوسط والجنوب)، سيما أنه سيؤدي سياسيا إلى العيش بسلام وتأمين الاستقرار في المنطقة والقضاء على الاستبداد الذي تسبب في خلق الوضع الأمني والعسكري الردئ في العراق في ضوء انتشار الإرهاب والفساد الإداري، وبالتالي سيحقق الاستقرار الداخلي للدول الأعضاء، ويضمن الدفاع العسكري والأمن الجماعي المشترك لحمايتها من أي خطر خارجي؛ كما أنه سيقوي الاقتصاد ويقضي على الفساد المالي ويخلق التنمية بين هذه الدول؛ وكذلك اجتماعيا-كونها نوع من حق تقرير المصير-سيماهم في تقريب وتعاون المجتمعات المتعددة القوميات والثقافات والأديان في إطار التعاهد الاستقلالي والاحترام المتبادل، وبالتالي المساهمة في حفظ السلم والأمن الدوليين في اطار القانون الدول العام.

The research studied "The Confederation and the Extent of its Applicability to Iraq - a Legal Political Study" through an introduction and two sections. In the first section, the quiddity (definitions & concepts) of confederation, characteristics and some of the practical implementations of the Confederacy are stated. In the second one, we have studied the separation of federal regions in the light of public international and constitutional laws, as well as the rationale for the establishment of the confederation and the extent of their applicability to Iraq. It is concluded that the confederation is distinguished from other similar concepts such as Federation and Regional International Organizations, which is regarded as a legal-political international association and one of the forms of International Union and Alliance that arises as a result of special circumstances, interests and considerations, in some parts of the world that suffer from political, security and economic problems and crises (as the current situation of Iraq) which is established through an international treaty between two or more states of full sovereignty vowed to exercise some of its powers to a joint mutual commission to manage the Union affairs and achieve its goals. Accordingly, in light of a number of logical incentive rationales (constitutional-legal, political, security, economical, and ethnographical), we have recommended that there is a possibility for applying this political experience in Iraq and establishing a unique confederation in its three areas (Kurdistan Region, Middle and South). Politically, this will led to eliminate tyranny that caused the security and military bad inferior situation as a result of the wide spread of extremism, terrorism and corruption, and therefore will bring internal stability to the State members, and ensure the common- collective military defense to protect them from any external danger. Furthermore, it will strengthen the economy, eliminate the administrative and financial corruptions and create development among these countries. Socially, regarded as a kind of Self-determination, it will contribute to closer cooperation for multi-ethnic societies, cultures and religions within the framework of compact autonomous and mutual respect. Eventually, it's for living maintaining international peace and security within the framework of public international law
