المستخلص: من الأمور الشائعة في مجال احتراف كرة القدم أن ينتقل اللاعب المحترف من ناديه إلى ناد آخر عقب انقضاء عقده، مقابل قيام النادي الجديد للاعب بدفع مبلغ من المال إلى النادي السابق يكون باهض الثمن، ولذلك فقد شاع استعمال عبارة "بيع وشراء اللاعبين" في الأوساط الرياضية، ولا يخفى على أحد ما في ذلك من إهانة لشخص اللاعبين، وخرق للمبادئ القانونية ، فالإنسان لا يمكن أن يكون محلا للتصرفات القانونية والمعاملات المالية، إنما هو طرف في تلك التصرفات، ولذلك ارتأينا بحث وتوضيح الإطار القانوني لعملية انتقال اللاعب المحترف لكرة القدم

Il est chose commune aujourd’hui dans le domaine du football professionnel de voir des joueurs passer d’un club à l’autre après expiration de leurs contrats moyennant de grosses sommes d’argent que le club recruteur donne à l’ancien club du joueur. Ainsi, les milieux footballistiques traitent souvent de ce genre de « vente-achat » de joueurs, ce qui fait penser sans doute à une certaine atteinte de la dignité humaine de ses professionnels, et le corollaire de cette atteinte qu’est la transgression des lois et des pratiques légales.
D’aucun s’accordent à dire que l’être humain ne peut être objet de transactions financières et des opérations légales, mais plutôt il doit être partie dans ces opérations.
Par conséquent, nous avons jugé la clarification et l’investigation du cadre légal de ce marché des joueurs professionnels, d’une importance centrale.

It is common in relation to professional football for a professional player to move from one club to another after his contract expires, in exchange for the new player's club paying a very large amount of money to the former club. As such, the term “buying and selling players” has been widely used in sports circles, whilst it is not hidden from anyone what such a statement contains in terms of insult to the players and a breach of legal principles. Human beings cannot be the subject of legal acts and financial transactions but are rather only a party to such actions. For this reason, we wanted to examine and clarify the legal framework related to the transfer of a professional football player.
