|a تعد مرحلة الطفولة مرحلة حساسة في حياة الفرد يمكن أن يقوم الصغير فيها بأفعال مخالفة للقانون تكيف ضمن نطاق الجنوح، ولكي يتم التعامل مع تلك الظاهرة ولمواجهتها قام المشرع الجزائري بتخصيص قانون لحماية الطفل وهيئه للتعامل مع تلك الفئة العمرية بتحديد مسؤوليتهم الجزائية وبإنشاء هيئة قضائية مختصة تباشر القواعد الإجرائية المطبقة على الجانحين في جميع مراحل الدعوى الجنائية من متابعة وتحقيق ومحاكمة، وإقامته على مبادئ، ومفاهيم مختلفة عن القواعد العامة في الكثير من الأحيان تبين أسس المعاملة الجنائية للطفل وتحدد معالمها.

|b Childhood is regarded as a sensitive period in the life of the individual, wherein he or she may commit acts against the law. To deal with this phenomenon, the Algerian legislator has made a law for the protection of the child which determines their penal responsibility and plans the establishment of a competent judicial institution to exercise the procedural rules applicable to the minors, in all the stages of the public action. This law establishes itself on principles different from general rules. And she clarifies the foundations of the penal treatment of the child and defines its Landmark.

|d La période de l’enfance est perçue comme une étape sensible dans la vie de l’individu, où il pourrait commettre des actes contraire à la loi. Pour traiter de ce phénomène, le législateur algérien a légiféré une loi sur la protection de l’enfance, qui détermine leur responsabilité pénale et prévoit l’établissement d’une institution judiciaire compétente pour exercer les règles procédurales applicables aux mineurs, dans toutes les étapes de l’action publique. Cette loi se fonde sur des principes différents des règles générales. Et elle clarifie les fondements du traitement pénal de l’enfant et définit ses contours.
