المستخلص: إنشاء المحكمة الجنائية الدولية لم يكن سهلا، بل رافق ميلادها عديد الصعوبات، أولها اختلاف النظم القانونية لدى الدول، والذي كان واضحا خلال المؤتمر الدبلوماسي المنعقد بروما 1998، وكذلك تباين مصالح الدول بشأنها. الأمر الذي جعل مسألة إنشاء المحكمة الجنائية تتوزع بين أبعاد إقامة نظام قضائي جنائي دولي يسعى لمعاقبة مرتكبي الجرائم الأشد خطورة، والتصدي لمحاولة إجهاض إنشاء المحكمة الجنائية الدولية، خاصة وأن الدول الكبرى وعلى رأسها الولايات المتحدة الأمريكية، لم تدخر جهدا في سبيل إفشال المشروع.

Establishment of the International Criminal Court has not been easy, but her birth was accompanied by many difficulties, the first being the different legal systems of the States, which was apparent during the Diplomatic Conference, held in Rome in 1998, as well as dissimilarity the countries interests’ about it. This made the issue of the establishment of the ICC distributed between establishment of an international criminal justice system, seeks to punish the perpetrators of the most serious crimes, and to address to try to abort the establishment of the International Criminal Court, especially the United States, has spared no effort to thwart the project.

La création de la Cour pénale internationale n'a pas été facile, mais accompagnée des nombreuses difficultés, le premier étant les différents systèmes juridiques des États, ce qui était évident lors de la Conférence diplomatique tenue à Rome en 1998, ainsi que les différents intérêts des pays. Cela a rendu la question de la création de la CPI répartie entre les dimensions de la mise en place d'un système de justice pénale internationale, cherche à punir les auteurs des crimes les plus graves, et d'arrêter l’obstruction de la cour pénale internationale, en particulier par l’États-Unis, qui n'a ménagé aucun effort pour l'échec du projet.
