المستخلص: One of the greatest matters which impact a man's life is choosing a wife, and it is for this matter that most marriages are preceded by an engagement period so both parties may asses compatibility, and may decide after a while to end their engagement if they find that they are incompatible with one another. As gifts are usually exchanged during this period, what is the Fiqhi ruling on all the exchanged money and gifts? I have tried my best in this humble research to answer this question. The importance of the topic: Due to an increase in disputes and conflicts created out of ending an engagement especially in this day and age, I decided to research this issue of ending an engagement, and the consequent harms and side effects, ways of overcoming these harms, and the Fiqhi ruling of such. Research methodology: The research topic will be addressed in two parts: the first:, and the second: analytical and descriptive. The research plan: The research plan consists of an introduction, a preface, four parts, a conclusion, and the indexes. The introduction includes the importance of the subject matter, the reason for choosing the same, the research methodology, previous studies, and the research plan. The preface includes the definition of an engagement linguistically and scientifically, the religious texts establishing its practise, the wisdom behind having an engagement, the Islamic ruling, and the consequences of such an engagement. Part one: the meaning of ending an engagement and the Islamic ruling on such. Part two: the impact of ending an engagement on the money paid in advance (dowry), and all the gifts. Part three: the effect of ending the engagement on the gold set given to the betrothed, or the shabkah. and the difference of opinion on the consideration in matter. Part four: the ruling of compensation for damages, whether monetary or mental in nature. Conclusion: the most important findings of the study and suggested recommendations.

إن من أعظم الأمور أثراً في حياة الإنسان اختيار الزوج لزوجته، ولهذا لا يخلو الزواج في كثير من الأحيان من خطبة تسبقه وتمهم له، وقد لا ينسجم الخاطب مع مخطوبته، فيعدل أحدهما أو طلاهما عن الخطبة بعد مضي فترة من الزمن، تبادلا فيها الأموال والهدايا، فما مصير هذا المال وتلك الهدايا من الناحية الفقهية؟ إن هذا البحث المتواضع محاولة مني للإجابة عن هذا السؤال. أهمية الموضوع: نظراً لكثرة الخلاف والنزاع بين الناس في هذه المسألة وخاصة في هذا الزمان الذي ابتعد فيه كثير من الناس عن دين الله، كان اختياري لهذا الموضوع كمحاولة لدراسة مشكلة العدول عن الخطبة وما يترتب عليه من آثار وأضرار، وكيفية التغلب عليها، بيان حكم الشرع فيها. منهجية البحث: سيتم تناول البحث –بإذن الله تعالي- ضمن محورين: الأول: نظري. الثاني: وصفي تحليلي. خطة البحث: تتكون خطة البحث من مقدمة، وتمهيد، وأربعة مباحث، وخاتمة، وفهارس: أما المقدمة: فقد تحدث فيها الباحث عن أهمية الموضوع وأسباب اختياره له، ومنهجه في البحث، والدراسات السابقة، وخطة البحث. وأما التمهيد: فقد جاء في تعريف الخطبة لغة وشرعاً، ودليل مشروعيتها، وحكمة مشروعيتها، وحكمها، وما يترتب عليها. والمبحث الأول: في معني العدول عن الخطبة وحكمه. والمبحث الثاني: في أثر العدول عن الخطبة على المال المدفوع سلفاً (على حساب المهر)، وعلى الهدايا. والمبحث الرابع: في حكم التعويض عن الضرر المادي أو المعنوي. والخاتمة: وفيها أهم النتائج التي توصلت إليها الدراسة والتوصيات المقترحة.
