المستخلص: The topic of this article deals with a historical, legal, and political issue at the same time, the problem of which is to highlight the discussions that have been put forward on the nature and form of the Algerian state during two different historical periods in Algeria, between what was built during the era of Ottoman rule in our country, and what some consider to be a model of an Algerian state established during the reign of Emir Abdelkader, and placed it in its framework from a historical, political and legal perspective, while reviewing the arguments and proofs of some parties on this topic.

يتناول موضوع هذا المقال قضية تاريخية، قانونية وسياسية في آن واحد، تتمثل إشكاليتها في إبراز المناقشات التي طرحت حول طبيعة وشكل الدولة الجزائرية خلال فترتين تاريخيتين مختلفتين في الجزائر، بين ما تم بناءه في عهد الحكم العثماني لبلادنا، وبين ما يعتبره البعض من نموذج لدولة جزائرية تأسست في عهد الأمير عبد القادر، ووضعها في إطارها الخاص من منظور تاريخي وسياسي وقانوني، مع استعراض حجج وبراهين بعض الأطراف حول هذا الموضوع.

Cette article essaye de décrire une question historique, juridique et politique en même temps, son problématique ce fixe a présenté les débats qui sont proposé sur la nature et la forme de l'état algérienne dans deux époque différente en Algérie, entre ce qui c'est fondé à l'époque ottomane dans notre pays, et celle qu'elle a était construit à l'époque de l'Emir Abdelkader. ont essayeront de la placer dans sa cadre spécial de point de vue historique, politique et juridique, on présentait les arguments et les preuves de certaines partie sur cette sujet.
