|a هذه الدراسة تهدف لدراسة موضوع حماية البيئة المائية في قانون حماية البيئة لسلطنة عمان. \nخلصت الدراسة إلي:\nإن الماء يشمل المياه السطحية أو الجوفية، سوء كانت عذبة أو مالحة أو شبه مالحة، ويحدث التلوث لهذه المياه بعدة أنواع منها التلوث بالنفط، التلوث الحراري، والتلوث الكيمائي، كما أن مصادر التلوث المائي متعددة. \nتعرض البحث للوسائل الإدارية لحماية البيئة العمانية إذ أن الوسائل القانونية في حماية البيئة تأتي في شكل قواعد قانونية آمرة، وغالباً ما تأتي تلك القواعد في صيغة النهي والأمر والإلزام والحظر، وهنالك العديد من الوسائل القانونية التي يكون الغرض منها حماية البيئة من التلوث. \nتناول البحث أركان وأنواع جرائم التلوث المائي حيث أوضح بأن هنالك عدد من الجرائم أهمها: جريمة تلويث البيئة المائية بتصريف المواد الخطرة، جريمة تلويث البيئة المائية بتصريف الزيت، جريمة التخلص من المخلفات النووية، كما أن هنالك تجريم وقائي الهدف منه الحد من تلوث البيئة المائية. \nتعرض البحث لموضوع المسئولية والتعويض، حيث أوضح بأنه يجب على من يتسبب في تلوث المياه دفع التكاليف اللازمة لإرجاع البيئة المائية للحالة التي كانت عليها قبل حدوث التلوث. \nأخيراً تناول البحث موضوع المحاكم المختصة، حيث أوضح بأن المحاكم الوطنية مختصة في معظم الحالات، كما أن النزاع يمكن أن يتم حله عن طريق التحكيم والصلح، كما أن هنالك اختصاص ينعقد لمحكمة العدل الدولية. \nوقد توصل البحث إلى عدة نتائج واختتم البحث بعدد من التوصيات التي قد تعين في هذا المجال.

|f This study aims at studying the subject of protecting the aquatic environment in the environmental protection law of the Sultanate of Oman.\nThe study concluded that:\nThe water includes the surface or groundwater, whether it is fresh, salty or semi-saline. Pollution occurs to water in several types, including oil pollution, thermal pollution and chemical pollution. There are many sources of water pollution.\nThe research deals with the administrative means to protect the Omani environment. Legal means to protect the environment come in the form of peremptory legal rules. These rules often come in the form of preventing, order, enforcement and prohibition, and there are many legal means that protect the environment from pollution.\nThe study deals with the elements and types of the crimes of water pollution. It pointed out that there are a number of crimes, the most important of which are: the crime of polluting aquatic environment by discharging hazardous materials, the crime of polluting the aquatic environment with the disposal of oil, the crime of disposal of nuclear waste. There is also a preventive criminalization aimed at reducing the pollution of the aquatic environment.\nThe research presented the topic of liability and compensation, explaining that those who cause water pollution must pay the costs necessary to restore the aquatic environment to the condition that existed before the pollution occurred.\nFinally, the study dealt with the subject of the competent courts, where it was explained that the national courts were competent in most cases. The dispute can also be resolved through arbitration and reconciliation, and there is competence held for the International Court of Justice.\nThe research reached several conclusions and it was concluded with a number of recommendations that may be useful in this field.
