تعد جريمة تمويل الإرهاب من الجرائم الخطرة حيث تستمد العمليات الإرهابية منها قوتها وحجم تأثيرها ودمارها وتعتبر من الجرائم العابرة للحدود، وتوالت التشريعات الدولية بتعريف تلك الجريمة وكانت اتفاقية الأمم المتحدة لقمع تمويل الإرهاب لسنة ١٩٩٩ هي أول تشريع يعرف تلك الجريمة كجريمة مستقلة ومنها استمدت التشريعات الوطنية تعريف تلك الجريمة. وترتكب جريمة تمويل الإرهاب من قبل الأفراد أو الجماعات بتوفير أو جمع الاموال وتقديمها للإرهابيين من اجل تنفيذ عملياتهم الإرهابية وان ارتكابها من قبل الأشخاص الطبيعيين أفراداً أو جماعات لا يمنع من ارتكابها من قبل الأشخاص المعنوية كمنظمات المجتمع المدني. أن كثرة إعداد منظمات المجتمع المدني بالآونة الأخيرة قاد إلى وجود بعض منظمات المجتمع المدني تستغل من قبل أصحاب النفوس الضعيفة للاعتداء على مصالح محمية بموجب القانون فنجد بعض منظمات المجتمع المدني ترتكب جريمة تمويل الإرهاب مستغلين بذلك ثقة المواطنين بتلك المنظمات التي وجدت بالأساس لتحقيق أغراض إنسانية، واعتمد البحث على أسلوب الدراسة المقارنة بين التشريعات العراقية والتشريعات المصرية والتشريعات الفرنسية. وانتظم البحث في مبحثين مسبوقين بتمهيد تطرقنا فيه إلى مفهوم منظمات المجتمع المدني وتناولنا في المبحث الأول مفهوم جريمة تمويل الإرهاب وفي تناولنا التعريف بجريمة تمويل الإرهاب وذاتيتها في مطلبين، وتناولنا في المبحث الثاني الأحكام الموضوعية لجريمة تمويل الإرهاب وفي أركان جريمة تمويل الإرهاب وجزاء جريمة تمويل الإرهاب ويكون ذلك في مطلبين.
