المستخلص: The research went through a number of propositions in an initially quick manner; each of which requires thorough examination missing no detail. Due to its significance, we find that they have been studied previously by Islamic thinkers, just as orientalists have studied them prior to us. They have not however been fully and suitably presented within the jurisprudence and religious collections, which focused upon producing contemporary jurisprudence and according to stable traditional methods. The research reflects an expression of the initial stirrings for the consolidation of the contemporary Ijtihaadaat (jurisprudent deductions) of the Sunni and Shia schools, in respect to their most prominent propositions, which were:
1 - The historical proposition.
2 - The proposition of the necessity to rely upon the modern linguistic tongues and studies.
3 - Ijtihaadaat (jurisprudent deductions) in relation to the Islamic rule; Al-Khomeini as a model.
4 - Hermeneutical interpretative studies among those who deal with exegesis.
5 -The presentation of opinions of some of the thinkers in respect to their viewpoints towards Usul ul-Fiqh (Principles of Islamic Jurisprudence) and the manner of renewing it; Hasan Hanafi and Muhammad Shahrur as models.
The research concluded the necessity to be open to modern scientific studies within the social, psychological and anthropological fields, to reach the consolidation of these philosophical, intellectual and linguistic propositions, and thereafter arrive at the optimal understanding of the reality, so as to produce contemporary jurisprudence that is appropriate to human greatness and to his immortality and finality

مر البحث بمقولات عدة بطريقة سريعة أولية، تحتاج كلا منها إلي وقفة كاملة عند كل شاردة وواردة منها. وهي على أهميتها نجددها قد درست من قبل بعض المفكرين الإسلاميين وأيضاً درسها المستشرقون قبلنا، ولم تحرر بشكل كامل ومناسب في المجاميع الفقهية والحوزات الدينية التي تركز على إنتاج الفقه المعاصر وبطرق تقليدية مستقرة... البحث عبارة عن اثارة أولية لتأصيل الاجتهادات المعاصرة في المدرستين الشيعية والسنية في أبرز مقولاتهم، وكانت
1. المقولة التاريخية.
2. مقولة ضرورة الاعتماد على الألسنية والدراسات اللغوية الحديثة.
3. الاجتهادات في الحكم الإسلامي الامام الخميني انموذجا.
4. الدراسات التأويلية الهرمنيونوطيقية عند شبستريسوسروش.
5. استعراض آراء بعض المفكرين في نظرتهم لأصول الفقه وكيفية تجديده حسن حنفي ومحمد شحرور انموذجا.
خلص البحث إلى ضرورة الانفتاح على الدراسات العلمية الحديثة في المجالات الاجتماعية والنفسية والانثروبولوجية للوصول إلى تأصيل لهذه المقولات الفلسفية والفكرية واللغوية والوصول إلى فهم أمثل للواقع وبالتالي لإنتاج فقه عصري يتناسب مع عظمة الإنسان وخلوده وخاتميته.
