|f The fundamentals of jurisprudence is one of the distinctive intellectual data in the Islamic nation drawn from laws to explore the provisions of the honored Islamic law in light of the jurisprudential research, and therefore it represents the law that protect the mind of the hard-working scholar from making mistakes in inference on the rulings of the Sharia from its detailed methods. The methodology of the fundamentals of jurisprudence is related to contemporary intellectual reality because of its association with jurisprudence and its link to the reality because of its important function in addition to the search in the provisions of the Islamic Shariah previously in terms of different inference. This is shown by searching in the areas of Shariah judgments in order to adapt them, by observing new incidents and developments especially with the openness of the Islamic world to other civilizations, which led some Islamic thinkers to adopt a new reading of the fundamentals of jurisprudence in order to find a treatment to the "problematic approach" in contemporary Islamic thought, to conclude and establish the foundations upon which the theory of science will be built, and dispel cognitive blindness. So the Critique of the methodology of the principles of jurisprudence is considered one of the most important intellectual problems in the Islamic sciences, because it is a primary risk to engage in the consideration of jurisprudential innovations, while maintaining its fixed principles, as well as in matters of interpretation of the text of the Holy Qoran and the Sunnah.\nContemporary thinkers have approached the traditional origins approach by criticizing that some of its topics are confined in matters of speech science and philosophy, and do not keep pace with developments in linguistics, stripped from following social change when formulating the overall rules sponsoring the deduction of sharia sub-rulings. In the current era, various currents and intellectual trends have emerged, under the pretext of changing societies and developing the sharia sciences and widening the field of diligence by observing the requirements of the technical developments and their accompanying repercussions by using the data of minds.\nIt is noted that the critical discourse project of the science of fundamentals of jurisprudence is taking three directions, including what is modern borrowed influenced by the foreign ideas, including what is dependent on predecessors, and what is reformist.\nIf some are inspired by the ideas of criticism influenced by the modernity of the West, this trend may be characterized as a dependence, such as the introduction of modern foreign words, taking evidence - this direction – by some connotations of sharia texts that suggest opening the horizon of ijtihad, and that the stability of the text does not cancel the flexibility of its content, and that it stores a living content. It is not bounded by the limits of time and space, calling in this light for the abolition of the constants.\nThere is another trend of the text and the adherence of the way of the predecessor method, wary of being dragged behind the new ideas, taking evidence of some of the texts that could help in maintaining the previous stable knowledge and preventing the introduction of new.\nAt the same time, there is a moderate tendency to view the issue of criticism of the fundamentalist approach in a moderate manner, in an attempt to keep pace with the reality on the one hand, and to preserve the spirit of the text and the preservation of the Islamic identity and the maintenance of its entity from each suspicion , in a reformist approach that does not detach from the sharia text on the other hand.\nSince the issue of criticism of the fundamentals of jurisprudence is a task between necessity and prevention, and the middle dependent view, it was represented in the following trends: First: is the need to criticize the approach to the science of fundamentals of jurisprudence in terms of both structural and content. The second, refutes the validity of the call to criticize the science of fundamentals of jurisprudence invalidating any attempt in this direction. The third is trying to reconcile the two previous opposing positions. It does not support a critique of the principles of jurisprudence as a whole, and does not reject the renewal of fundamentals of jurisprudence completely. For the sake of meditation and consideration of these trends , this research came on three topics: The first topic: the need for criticism and renewal. The second topic, the stability of the methodology. The third topic: detailing and mediation. This is to stand on the most important in this criticisms and treatment them after the diagnosis of non-opposing with the constants.
