|a تهدف هذه الدراسة إلى بياندور الاجتهاد المآلي فيما لا نص فيه من أفعال المكلفين في تحقيق مقاصد الشريعة من خلال بيان أهمية فهم مقاصد الشريعة وتسخير هذا الفهم في عملية الاجتهاد الفقهي القائم على أدوات الاجتهاد المآلي لاستنباط أحكام النوازل وإصدار الأحكام فيها بما يتماشى وقواعد التشريع، وقد ركز الباحث في هذه الدراسة على بيان معنى الاجتهاد المآلي عند علماء الأصول، وتحديد ضوابطه وبيان أدواته وعلاقته بالمصلحة لإظهار أثر هذا النوع من الاجتهاد في تحقيق مقاصد الشريعة. وقد اعتمد الباحث في هذه الدراسة على منهجين رئيسين هما المنهج الاستقرائي والمنهج الوصفي التحليلي. وكان من أبرز نتائج هذه الدراسة أن المقصود بالاجتهاد المآلي مراعاة المجتهد نتائج الحكم لتحقيق مقاصد الشرع عند الحكم على أفعال المكلفين، وأن أدلة اعتبار المآل في القرآن الكريم والسنة النبوية الشريفة وآثار الصحابة كثيرة كما أن تحقيقه من المجتهد يكون بمراعاة أحوال الزمان والمكان والأشخاص والظروف عند الاجتهاد، ليعمل في الوقت ذاته على إذابة كل الحواجز بين الحكم الشرعي والواقع العملي المعاش، وأن المجتهد قادر على تحقيق مقاصد الشرع في ما يصدر عنه من أحكام باستخدام أدوات الاجتهاد المآلي والتي أهمها الاستحسان وقاعدة سد الذرائع.
