المستخلص: خطت الدول العربية، في مجال تحقيق نظام عربي لحماية حقوق الإنسان، خطوة كبيرة بإنشائها محكمة عربية لهذا الغرض. وعلى الرغم من أن إنشاء تلك المحكمة جاء متأخرا جدا مقارنة مع نظيراتها من الأنظمة الإقليمية الأخرى إلا أن الوثائق والصكوك العربية المتعلقة بحقوق الإنسان في البلدان العربية عرفت محاولات مبكرة ومتكررة لكنها كلها أفضت إلى الفشل إلى أن أفرج عنها مع مطلع الألفية بالموافقة بنجاح على الميثاق العربي لحقوق الإنسان، ثم إنشاء اللجنة العربية لحقوق الإنسان ثم تأسيس المحكمة العربية لحقوق الإنسان عام 2014. ومع كل ذلك. ثمة العديد من الانتقادات لهذا النظام مقارنة بالنظام الأوروبي لحقوق الإنسان الذي يعتبر نموذجا فذاً لكفالة الحقوق الإنسانية بالسماح للأفراد أنفسهم بالتقاضي أمام لمحكمة وبتخويل الأجهزة المختصة صلاحيات واسعة في إطار مهامها. وعلى ذلك، فإن هذا المقال يستعرض النظام العربي لحقوق الإنسان من خلال عرض مواثيقه وصكوكه أولا ثم يعرج على آلياته التي تكفل احترام تلك المواثيق والصكوك كل ذلك في إطار استعراض جانبي للنظام الأوروبي لحقوق الإنسان من حيث المواثيق الآليات في شكل مقارنة بسيطة للوصول إلى المدى الذي وصل إليه النظام العربي مع النظام الأوروبي.

In the domain of achieving an Arab system for the protection of human rights, the Arab countries have taken a major step by establishing an Arab court for this purpose. Although the establishment of the Court was too late compared to its counterparts from other regional regimes, Arab offices and institutions related to human rights in Arab countries witnessed early and repeated attempts but all of them led to failure until it was released at the beginning of the millennium with the successful approval of the Arab Charter on Human Rights and the subsequent establishment of the Arab Commission for Human Rights and the establishment of the Arab Court for Human Rights in 2014. And with all that. There are many criticisms of this system compared to the European system of human rights, which is a remarkable model for guaranteeing human rights by allowing individuals themselves to file sues in the court and by giving the competent organs broad powers within the framework of their functions. Therefore, this article reviews the Arab system of human rights by first presenting its charters and instruments and then introduces its mechanisms to ensure respect for those charters and instruments, all within the framework of a review from a perspective for the European human rights system in terms of charters and mechanisms in the form of a simple comparison to assess the extent to which the Arab system has come closer to the European system.
