المستخلص: تعد الهجرة غير الشرعية مشكلة العصر، ونظرا لتفاقم هذه الظاهرة على المستويين الوطني والدولي نحاول من خلال هاته الدراسة تسليط الضوء على حكمها الشرعي، خاصة إذا علمنا أنها تتم بطريقة تعرض النفس للخطر من جهة، والاختلاف الحاصل بين الفقهاء حول حكم الهجرة بوجه عام من جهة أخرى، ومنه تهدف من خلال هذا البحث تشخيص الهجرة غير الشرعية من منظور إسلامي.

l'émigration illégal est un problème de notre époque. vu que ce phénomène augmente à l’échelle nationale et à l’échelle international. nous tenterions a travers cette étude de mettre la lumière sur le jugement religieux, surtout si nous savons qu'elle se fait d'une façon qui met l’être en péril, d’une part et que le désaccord entre les théologiens musulmans reste encore autour du jugement islamique sur ce problème d'autre part en effet notre bute de cette recherche est diagnostiquer l’émigration illégal dans un coin islamique.

Illegal immigration is the problem of the times, and given the aggravation of this phenomenon at the national and international levels, we try through this study to shed light on its legal ruling, especially if we know that it is done in a way that exposes oneself to danger on the one hand and the difference between jurists about the ruling on migration in general on the other hand.
