المستخلص: أدت التحولات الحاصلة على الساحة الدولية لا سيما بعد نهاية الحرب الباردة إلى إحداث تغييرات جوهرية على القواعد والأعراف والدعائم التي قامت عليها العلاقات الدولية منذ معاهدة ويستيفاليا، حيث لم تعد الدولة الوطنية الفاعل الوحيد في العلاقات الدولية، فبالإضافة إلى الشركات المتعددة الجنسيات والمنظمات الدولية الحكومية والغير حكومية أصبح الفرد فاعلاً جديداً يحتل مكانة هامة لدى الجماعة الدولية، إذ أصبحت حقوق الإنسان وأمنه داخل الدولة الوطنية محل متابعة حثيثة من طرف الهيئات الدولية، وبذلك لم يعد بمقدور الدولة الوطنية التصرف بحرية مطلقة في تصريف شؤونها الداخلية بمقتضى حقوق السيادة الوطنية، وهذا ما فرض قيودا على حرية الدولة في اتخاذ قراراتها على الصعيد الداخلي والخارجي.

Les transformations qu’a connues la scène internationale, surtout après la fin de la guerre froide ont apporté des changements fondamentaux aux règles des relations internationales depuis le traité de Westphalie, puisque l’état nation n’est plus considérée comme le seul acteur dans les relations internationales, des multinationales, les organisations internationales gouvernementales et non gouvernementales, l'individu est devenu en plus un nouvel acteur qui occupe une place importante au sein de la communauté internationale, où les droits de l'homme et sa sécurité au sein de l'Etat national sont devenus vigoureusement suivis par des organisations internationales, et pour cela l'état nation ne peut pas agir librement dans la gestions de ses affaires internes dans le cadre des droits de souveraineté nationale, ce qui a créé des restrictions à la liberté d'état dans la prise des décisions sur le plan interne et externe.

The transformations taking place on the international scene, especially after the end of the Cold War, led to fundamental changes in the rules, norms, and pillars on which international relations were based since the Peace of Westphalia, where the national state was no longer the only actor in international relations, in addition to multinational companies and international governmental and non-governmental organizations, the individual had become a new actor that occupied an important position in the international community, as international bodies closely monitored human rights and security within the national state. Thus, the national state could no longer act freely in the conduct of its internal affairs according to the rights of national sovereignty.
