|a يعد مبدأ حرية التعبير من الحقوق الأساسية الملازمة للإنسان فهي أهم الوسائل التي يعبر فيها الإنسان عن رأيه، معتقده، كافة شئون حياته، ونظراً لأهمية ﻫﺬﺍ الحق فقد كفلته الشريعة الإسلامية والقانون الدولي لحقوق الانسان باعتباره من الشروط الأساسية لتقدم أي مجتمع وتطوره. وكما أن حرية التعبير حق لكل إنسان فكان لابد من تقرير ضوابط تراعي المصلحة، وتحقق المقصود من إقراره، ولقد تم وضع مجموعة من الضوابط الشرعية تمثلت في الالتزام بمشروعية القول والأخلاق والقيم والمبادئ، عدم الاعتداء على أعراض الآخرين، ضابط عدم الاعتداء على المصلحة العامة، ضابط تحديد المقصد والهدف والغاية والوسيلة. ووضع القانون الدولي لحقوق الانسان مجموعة من الضوابط تمثلت في ضابط عدم انتهاك حقوق الآخرين وحمايتها، ضابط عدم مخالفة النظام العام أوالأمن القومي أو الصحة والآداب والأخلاق العامة، ضابط عدم الدعاية للحرب، ضابط الأمن القومي.
