تمثل حقوق الإنسان أهمية بالغة في ظل تطور المجتمعات وزيادة مجال المعاملات على الصعيدين الوطني والدولي وهي تعتبر فرع من فروع القانون الدولي يطلق عليها اسم القانون الدولي لحقوق الأنسان، ما جعل من مسالة حماية حقوق الأنسان مسالة جوهرية استوجب السهر على حمايتها و كفالتها و الرقابة عليها، فإضافة إلى الجهود المبدولة على الصعيد الدولي من اتفاقيات ومعاهدات دولية تتعلق بحماية حقوق الإنسان نلاحظ تواجد أيضا آليات فعالة على الصعيد الوطني تسهر على ضمان حماية الحق الإنساني والتي تعرف بالآليات الوطنية لحماية حقوق الإنسان سواءا كانت رسمية أو غير رسمية ونقصد بالرسمية حكومية أو قضائية، و بالغير الرسمية المؤسسات الوطنية والمنظمات الغير حكومية و المجتمع المدني و الإعلام، فكل دولة لا تخلو من الهياكل الحكومية المعنية بحقوق الإنسان وإن تباينت طبيعتها وأدوارها تباينا كبيراً، أما الآليات الغير رسمية فأننا نجد نوعا من التفاوت في الأشكال فبعض البلدان لا تتوافر على مؤسسات وطنية أو دواوين مظالم أو لجان برلمانية متخصصة، أو حتى منظمات غير حكومية تعمل في مجال حقوق الإنسان. وتدور مهام هذه الآليات الوطنية حول ثلاثة وظائف رئيسية هي: الإنصاف القضائي، وإشاعة مبادئ وقيم حقوق الإنسان في المجتمع، وحماية حقوق الأفراد والجماعات من انتهاك حقوقهم القانونية.

The spin of these national mechanisms tasks around three main functions: judicial fairness, to promote the principles and values of human rights in society, and to protect the rights of individuals and groups from violating their legal rights.
