|a أمام تبني النهج الاقتصادي الحر أصبح دور الدولة في هذا المجال حاليا يتجسد وراء فكرة قانونية حديثة وهي فكرة الضبط، هذه الأخيرة التي تمارس من طرف هيئات عمومية تدعى سلطات الضبط المستقلة ،تضطلع بهذه المهمة الأساسية داخل السوق المالية الجزائرية لجنة تنظيم عمليات البورصة ومراقبتها والتي تعد حجر زاوية أساسي لتدخل الدولة وضبط هذه السوق، فقد خول لها المشرع العديد من السلطات منها سلطة التأديب والتحكيم على مستوى غرفة تدخل ضمن تشكيلتها تدعى الغرفة التأديبية والتحكمية، تعمل على إصدار بعض العقوبات ذات الطابع التأديبي عند إخلال الوسطاء ببعض الالتزامات ذات الطابع المهني، وعليه وفي هذا الإطار يثور التساؤل وبشدة حول مدى كفالة حقوق الدفاع لهؤلاء الوسطاء أمام هذه الغرفة على اعتبار أنها تعد شكلا من القضاء المتخصص بشكل أو بأخر؟ بالإضافة إلى مدى احترام المبادئ الدستورية عند إقرار العقوبة التأديبية من طرف هذه الأخيرة

|b After teh adoption of teh free economic approach, teh role of teh state in dis area is reflected behind a modern legal idea of economic adjustment, teh latter practiced by public bodies called independent administrative authorities, Undertake dis essential task wifin teh Algerian stock market, teh commission for teh organization and supervision of stock exchange operations, which is an essential cornerstone of State intervention and control of teh market and which is authorized by Teh legislator of many powers, including disciplinary and arbitration authority at teh level of a chamber in it's range called teh Disciplinary and Arbitration Chamber, Teh latter which imposes disciplinary sanctions in case of violation of some of teh professional obligations, In dis context teh question arises strongly as to teh extent of teh guarantee of teh rights of defense of these stockbroker before dis Chamber because it is a form of a specialized justice in one way or another? In addition, to teh extent that teh constitutional principals are respected on teh adoption of disciplinary sanctions by teh latter.
