تناولت هذه الدراسة جريمة الإتجار بالأعضاء البشرية كجريمة مستجدة أفرزها التقدم العلمي والتكنولوجي الذي تحقق في مختلف المجالات، ومنها علي وجه الخصوص المجال الطبي وهدفت إلي التعرف إلي خصائص هذه الجريمة، والعوامل وراء أنتشارها، وعلاقتها بالتغيرات الاجتماعية، وآثارها في الفرد والنسق الأسري والبناء الاجتماعي وأبرز ضحاياها وتنبثق أهميتها من كونها تتناول جريمة مستجدة هي من أخطر الجرائم التي تهدد صحة الإنسان وسلامة أعضائه، وتهدد أمن وسلامة المجتمع، كما تنبثق أيضا أهميتها من حيوية موضوع جريمة الاتجار بالأعضاء البشرية، ومن تناوله المحدد في أدبيات الدراسات العربية، وفي ضوء طبيعة هذه الدراسة وتساؤلاتها وأهدافها التي تسعي إلي تحقيقها، تم استخدام المنهج التحليلي القائم علي التفسير والتحليل بوصفه المنهج الملائم لطبيعة هذه الدراسة، وقد خلصت إلي عدد من النتائج منها: أن من أبرز خصائص جريمة الإتجار بالأعضاء البشرية أنها جريمة ذات طابع دولي تتأثر بمظاهر العولمة، وهي جريمة مركبة غالباً ما ترتبط بأكثر من جريمة وتمارس من قبل عصابات منظمة، وتعتمد علي السرية، وغالباً لا تظهر في الإحصاءات الجنائية الرسمية ومن أبرز العوامل وراء أنتشارها تطور الاتصالات والتطور في مجال استئصال وزراعة الأعضاء البشرية، واكثر ضحاياها هم الفقراء والأطفال والمشردون والمهاجرون وبأن هذه الجريمة تضعف المعايير الاجتماعية والأخلاقية والدينية في المجتمع وقد تعمل علي تغيير وظيفة الأسرة وتسهم في جرائم أخري، وخلصت الدراسة في ضوء نتائجها إلي عدد من التوصيات منها ضرورة التنسيق بين الجهات الأمنية والجهات الطبية علي المستويين المحلي والدولي، وأن تعمل المؤسسات التربوية والإعلامية علي رفع مستوي الوعي لدي جميع أفراد المجتمع بمخاطر جريمة الإتجار بالأعضاء، وبأن تتجه الإجراءات الوقائية في المجتمع إلي الفئات الأكثر عرضة لأن يصبحوا ضحايا لهذه الجريمة، كما أوصت الدراسة بضرورة تشجيع البحوث الطبية التي من شأنها أن تؤدي إلي اكتشاف بدائل العلاج المرضي دون الحاجه إلي استئصال وزرع أعضاء بشرية.
This study handled with the crime of trafficking in human organs as an emerging crime as discharged by scientific and technological progress in different fields and in particular the medical field. This study aimed to recognize specifications of this crime, its widespread factor, its relationship to social changes and its influence to individual, family pattern, social structure and its prime victims as well. The importance of this study emerges from its handling of an emerging crime which is one of the most dangerous crimes, as threatens human health, human organs safety and safety and security of the community. Furthermore, the importance of this study emerges from the vitality of the crime of trafficking in human organs and the limited handling through the fundamentals of Arabic studies. The analytical approach based on interpretation and analysis has been implemented in the light of the nature of this study, as well it described as the appropriate approach to the nature of this study. Then I've got a number of results, include: one of the prominent specifications of this crime is its international character as it influences with manifestations of globalization, its a compounding crime as it often relates to more than one crime, its conducted by organized gangs, it depends on secrecy and it often doesn't count in the official crime statistics. Its widespread main factor: communication development and the development of removal and transplantation of human organs field whose most victims are the poor people, children, displaced people and immigrants. Moreover, this crime declined the social, moral and religious standards in community and it may work on changing family function and participate in another crime. I have got a number of recommendations through the light of this study, include: the need of coordination between security and medical authorities at domestic and international levels, the educational and media institutions shall work on raising awareness of the danger of trafficking in human organs crime to all community members, the preventive actions shall target the most vulnerable to be victims of this crime in community and the study recommended also with the essentiality of promoting the medical research which lead to discover alternatives to treat patients without the need to the removal and transplantation of human organs.
